88 relating to the Texas Jobs, Energy, Technology, and Innovation Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 406.609(b), Government Code, is amended
1111 to read as follows:
1212 Sec. 403.609. COMPTROLLER ACTION ON APPLICATION. (a) The
1313 comptroller shall determine whether to recommend or not recommend
1414 for approval an application submitted to the comptroller under
1515 Section 403.607. The comptroller shall recommend an application
1616 for approval if the comptroller makes the findings prescribed by
1717 Subsection (b). The comptroller may not recommend an application
1818 for approval if the comptroller is unable to make the findings
1919 prescribed by that subsection.
2020 (b) The comptroller may not recommend an application for
2121 approval unless the comptroller finds that:
2222 (1) the proposed project that is the subject of the
2323 application is an eligible project;
2424 (2) the proposed project is reasonably likely to
2525 generate, before the 20th anniversary of the first day of the
2626 construction period, state or local tax revenue, including ad
2727 valorem tax revenue attributable to the effect of the project on the
2828 economy of this state, in an amount sufficient to offset the school
2929 district maintenance and operations ad valorem tax revenue lost as
3030 a result of the agreement;
3131 (3) for a project described by Section
3232 403.602(8)(A)(i)(a), (c), (d) or (ii), the agreement is a
3333 compelling factor in a competitive site selection determination and
3434 that, in the absence of the agreement, the applicant would not make
3535 the proposed investment in this state; and
3636 (4) if the application indicates that the eligible
3737 project is proposed to be located in a qualified opportunity zone,
3838 the project is located in the zone.
3939 (c) In making the finding required by Subsection (b)(3), the
4040 comptroller shall consider factors related to the selection of the
4141 proposed site for the project, including the workforce, the
4242 regulatory environment, infrastructure, transportation, market
4343 conditions, investment alternatives, and any specific incentive
4444 information provided by the applicant related to other potential
4545 sites.
4646 (d) Not later than the 60th day after the date the
4747 comptroller determines that an application is complete, the
4848 comptroller shall take the action required by Subsection (a)
4949 regarding the application and provide written notice of the action
5050 to the governor, the school district in which the project is
5151 proposed to be located, and the applicant.
5252 (e) The comptroller shall send to the governor and the
5353 applicable school district with the notice required by Subsection
5454 (d) regarding an application recommended by the comptroller under
5555 Subsection (a) a copy of the application and each document and item
5656 of information the comptroller relied on to recommend the
5757 application.
5858 SECTION 2. This Act takes effect September 1, 2025.
