66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to protesting changes to municipal zoning regulations and
99 boundaries.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 211.006(d), Local Government Code, is
1212 amended to read as follows:
1313 (d) If a proposed change to a regulation or boundary other
1414 than in a zoning classification affecting residential is protested
1515 in accordance with this subsection, the proposed change must
1616 receive, in order to take effect, the affirmative vote of at least
1717 three-fourths of all members of the governing body. The protest
1818 must be written and signed by the owners of at least 20 percent of
1919 either:
2020 (1) the area of the lots or land covered by the proposed
2121 change; or
2222 (2) the area of the lots or land immediately adjoining the
2323 area covered by the proposed change and extending 200 feet from that
2424 area.
2525 (d-1) If a proposed change to a regulation or boundary in a
2626 zoning classification affecting residential is protested in
2727 accordance with this subsection, the proposed change must receive,
2828 in order to take effect, the affirmative vote of a majority of all
2929 members of the governing body. The protest must be written and
3030 signed by the owners of at least 50 percent of either:
3131 (1) the area of the lots or land covered by the proposed
3232 change; or
3333 (2) the area of the lots or land immediately adjoining the
3434 area covered by the proposed change and extending 200 feet from that
3535 area.
3636 SECTION 2. The changes in law made by this Act apply only to
3737 a proposal to change a municipal zoning regulation or zoning
3838 district boundary for which notice is given on or after the
3939 effective date of this Act. A proposal to change a municipal zoning
4040 regulation or zoning district boundary for which notice is given
4141 before the effective date of this Act is governed by the law in
4242 effect on the date the notice was given, and the former law is
4343 continued in effect for that purpose.
4444 SECTION 3. This Act takes effect September 1, 2025.
