8 | 8 | | relating to protesting changes to municipal zoning regulations and |

9 | 9 | | boundaries. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 211.006(d), Local Government Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | (d) If a proposed change to a regulation or boundary other |
---|
14 | 14 | | than in a zoning classification affecting residential is protested |
---|
15 | 15 | | in accordance with this subsection, the proposed change must |
---|
16 | 16 | | receive, in order to take effect, the affirmative vote of at least |
---|
17 | 17 | | three-fourths of all members of the governing body. The protest |
---|
18 | 18 | | must be written and signed by the owners of at least 20 percent of |
---|
19 | 19 | | either: |
---|
20 | 20 | | (1) the area of the lots or land covered by the proposed |
---|
21 | 21 | | change; or |
---|
22 | 22 | | (2) the area of the lots or land immediately adjoining the |
---|
23 | 23 | | area covered by the proposed change and extending 200 feet from that |
---|
24 | 24 | | area. |
---|
25 | 25 | | (d-1) If a proposed change to a regulation or boundary in a |
---|
26 | 26 | | zoning classification affecting residential is protested in |
---|
27 | 27 | | accordance with this subsection, the proposed change must receive, |
---|
28 | 28 | | in order to take effect, the affirmative vote of a majority of all |
---|
29 | 29 | | members of the governing body. The protest must be written and |
---|
30 | 30 | | signed by the owners of at least 50 percent of either: |
---|
31 | 31 | | (1) the area of the lots or land covered by the proposed |
---|
32 | 32 | | change; or |
---|
33 | 33 | | (2) the area of the lots or land immediately adjoining the |
---|
34 | 34 | | area covered by the proposed change and extending 200 feet from that |
---|
35 | 35 | | area. |
---|
36 | 36 | | SECTION 2. The changes in law made by this Act apply only to |
---|
37 | 37 | | a proposal to change a municipal zoning regulation or zoning |
---|
38 | 38 | | district boundary for which notice is given on or after the |
---|
39 | 39 | | effective date of this Act. A proposal to change a municipal zoning |
---|
40 | 40 | | regulation or zoning district boundary for which notice is given |
---|
41 | 41 | | before the effective date of this Act is governed by the law in |
---|
42 | 42 | | effect on the date the notice was given, and the former law is |
---|
43 | 43 | | continued in effect for that purpose. |
---|
44 | 44 | | SECTION 3. This Act takes effect September 1, 2025. |
