1310 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1411 SECTION 1. The heading to Section 550.041, Transportation
1512 Code, is amended to read as follows:
16- Sec. 550.041. INVESTIGATION BY PEACE OFFICER OR DESIGNEE OF

1815 SECTION 2. Section 550.041, Transportation Code, is amended
19- by adding Subsection (c) to read as follows:
20- (c) A former peace officer who is designated by a law
21- enforcement agency and who has successfully completed a training
22- program on investigating motor vehicle collisions approved by the
23- Texas Commission on Law Enforcement may investigate a motor vehicle
24- collision, without regard to whether the collision occurred on
25- property to which this chapter applies, if:
26- (1) no offense was committed during the collision; and

18+ (a) A peace officer who is notified of a motor vehicle
19+ collision resulting in injury to or death of a person or property
20+ damage to an apparent extent of at least $5,000 [$1,000] may
21+ investigate the collision and file justifiable charges relating to
22+ the collision without regard to whether the collision occurred on
23+ property to which this chapter applies.
24+ (c) An employee of a law enforcement agency who is not a
25+ peace officer, and who has successfully completed a training
26+ program on investigating motor vehicle collisions that satisfies
27+ any applicable requirements of Section 1701.253, Occupations Code,
28+ may investigate a motor vehicle collision, without regard to
29+ whether the collision occurred on property to which this chapter
30+ applies, if:
31+ (1) no offense was committed during the collision
32+ other than a misdemeanor punishable by fine only;
2733 (2) no injury or death of a person occurred as a result
28- of the collision.
29- SECTION 3. The heading to Section 550.062, Transportation
30- Code, is amended to read as follows:
34+ of the collision; and
35+ (3) any property damage that resulted from the
36+ collision was to an apparent extent of less than $5,000.

32- DESIGNEE'S COLLISION REPORT.
33- SECTION 4. Section 550.062, Transportation Code, is amended
34- by adding Subsection (a-1) and amending Subsections (b), (b-1), and
35- (c) to read as follows:
36- (a-1) A former peace officer who is designated by a law
37- enforcement agency to investigate a motor vehicle collision in
40+ EMPLOYEE'S COLLISION REPORT. (a) A law enforcement officer who in
41+ the regular course of duty investigates a motor vehicle collision
42+ shall make a written report of the collision if the collision
43+ resulted in injury to or the death of a person or damage to the
44+ property of any one person to the apparent extent of $5,000 [$1,000]
45+ or more.
46+ (a-1) An employee of a law enforcement agency who is not a
47+ peace officer and who investigates a motor vehicle collision in
3848 accordance with Section 550.041(c) shall make a written report
3949 summarizing the findings of the investigation.
4050 (b) The report required by Subsection (a) or (a-1) must be
4151 filed electronically with the department not later than the 10th
4252 day after the date of the collision.
4353 (b-1) If the motor vehicle collision involved a combination
4454 of vehicles operating under a permit issued under Section 623.402,
4555 the report required by Subsection (a) or (a-1) must include the
4656 weight and the number of axles of the vehicle combination.
4757 (c) This section applies without regard to whether the
48- officer or former peace officer designated by a law enforcement
49- agency, as applicable, investigates the collision at the location
50- of the collision and immediately after the collision or afterwards
51- by interviewing those involved in the collision or witnesses to the
52- collision.
53- SECTION 5. Section 550.068, Transportation Code, is amended
54- to read as follows:
55- Sec. 550.068. CHANGING COLLISION REPORT. (a) Except as
56- provided by Subsection (b), a change in or a modification of a
57- written report of a motor vehicle collision prepared by a peace
58- officer or former peace officer designated by a law enforcement
59- agency that alters a material fact in the report may be made only by
60- the peace officer or former peace officer, as applicable, who
61- prepared the report.
62- (b) A change in or a modification of the written report of
63- the collision may be made by a person other than the peace officer
64- or former peace officer, as applicable, who prepared the report if:
65- (1) the change is made by a written supplement to the
66- report; and
67- (2) the written supplement clearly indicates the name
68- of the person who originated the change.
69- SECTION 6. This Act takes effect September 1, 2025.
