99 relating to content filters provided by Internet service providers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle B, Title 10, Business & Commerce Code,
1212 is amended by adding Chapter 330 to read as follows:
1313 CHAPTER 330. CONTENT FILTERS PROVIDED BY INTERNET SERVICE
1414 PROVIDERS
1515 Sec. 330.001. DEFINITIONS. In this chapter:
1616 (1) "Customer" means a person in this state who
1717 purchases Internet service from an Internet service provider.
1818 (2) "Explicit material" means visual material
1919 depicting:
2020 (A) the intimate parts of a person;
2121 (B) sexual conduct; or
2222 (C) simulated sexual conduct.
2323 (3) "Filter" means software provided to a customer by
2424 an Internet service provider that is capable of preventing the
2525 customer from accessing or displaying explicit material.
2626 (4) "Internet service provider" means a person
2727 providing connectivity to the Internet or another wide area
2828 network.
2929 (5) "Sexual conduct" has the meaning assigned by
3030 Section 21.16, Penal Code.
3131 (6) "Simulated" has the meaning assigned by Section
3232 21.16, Penal Code.
3333 (7) "Visual material" has the meaning assigned by
3434 Section 21.16, Penal Code.
3535 Sec. 330.002. OPTIONAL CONTENT FILTER. (a) An Internet
3636 service provider shall make available to each customer a filter
3737 that the customer can choose to enable on the customer's Internet
3838 service.
3939 (b) A filter described by Subsection (a), when enabled,
4040 must:
4141 (1) prevent a customer from accessing, downloading, or
4242 displaying explicit material when using the Internet service
4343 provided by the Internet service provider; and
4444 (2) notify the customer using the Internet service
4545 when the filter prevents the customer from accessing or displaying
4646 explicit material.
4747 (c) An Internet service provider shall make the filter
4848 described by Subsection (a) available at no additional cost to the
4949 customer.
5050 SECTION 2. This Act takes effect September 1, 2025.
