77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to establishing a minimum wage for school bus drivers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 62, Labor Code, is amended
1212 by adding Section 62.058 to read as follows:
1313 Sec. 62.058. MINIMUM WAGE FOR SCHOOL BUS DRIVERS. (a) In
1414 this section, "school bus driver" means a person employed to
1515 transport students to or from school or a school-sponsored or
1616 school-related activity.
1717 (b) This section applies to:
1818 (1) a public school district with a student enrollment
1919 of 4,500 or more;
2020 (2) an open-enrollment charter school; and
2121 (3) a mass transit authority, commercial
2222 transportation company, or juvenile board that contracts with a
2323 school district described by Subdivision (1) or an open-enrollment
2424 charter school to provide public school transportation.
2525 (c) Notwithstanding Section 62.051 or 62.151 or any other
2626 law, an employer to which this section applies shall pay to each
2727 school bus driver employed by the employer not less than the greater
2828 of:
2929 (1) $15 an hour; or
3030 (2) the federal minimum wage under Section 6, Fair
3131 Labor Standards Act of 1938 (29 U.S.C. Section 206).
3232 SECTION 2. This Act takes effect September 1, 2025.
