88 AN ACT
99 relating to requiring certain disclosures in relation to the
1010 purchase of electronic media by consumers; providing a civil
1111 penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is
1414 amended by adding Chapter 121 to read as follows:
1515 CHAPTER 121. PROHIBITION ON REMOVAL OF ACCESS TO PURCHASED
1616 ELECTRONIC MEDIA
1717 Sec. 121.001. PROHIBITION ON REMOVAL OF ACCESS TO PURCHASED
1818 ELECTRONIC MEDIA. (a) In this section:
1919 (1) "Electronic media" means a film, television
2020 program, or computer or video game.
2121 (2) "Electronic media platform" means a business that
2222 operates or provides an online application, software, Internet
2323 website, system, or other medium through which electronic media is
2424 sold to consumers.
2525 (b) In this state, an electronic media platform shall
2626 provide a written disclosure to each person who purchases
2727 electronic media through the platform that informs the person that
2828 access to the electronic media is not guaranteed in perpetuity and
2929 may expire at a later date.
3030 (c) An electronic media platform that violates Subsection
3131 (b) is liable to this state for a civil penalty of not less than
3232 $7,500 for each violation. The attorney general may bring an action
3333 to recover the civil penalty imposed by this subsection.
3434 SECTION 2. This Act takes effect September 1, 2025.
