11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 121.005(a), Civil Practice and Remedies | |
13 | 13 | Code, is amended to read as follows: | |
14 | 14 | (a) An officer may not take the acknowledgment of a written | |
15 | 15 | instrument unless the officer knows or has satisfactory evidence | |
16 | 16 | that the acknowledging person is the person who executed the | |
17 | 17 | instrument and is described in it. An officer may accept, as | |
18 | 18 | satisfactory evidence of the identity of an acknowledging person, | |
19 | 19 | only: | |
20 | 20 | (1) the oath of a credible witness who: | |
21 | 21 | (A) is personally known to the officer; or | |
22 | 22 | (B) provides the officer with a current | |
23 | 23 | identification card or other document issued by the federal | |
24 | 24 | government or any state government that contains the photograph and | |
25 | 25 | signature of the witness; | |
26 | 26 | (2) a current identification card or other document | |
27 | 27 | issued by the federal government or any state government that | |
28 | 28 | contains the photograph and signature of the acknowledging person; | |
29 | 29 | or | |
30 | 30 | (3) with respect to a deed or other instrument | |
31 | 31 | relating to a residential real estate transaction, a current | |
32 | 32 | passport issued by a foreign country. | |
33 | 33 | SECTION 2. This Act takes effect September 1, 2025. |
