88 AN ACT
99 relating to the establishment of a hike and bike trail to be known
1010 as the Bicentennial Trail.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 31, Natural Resources Code, is amended
1313 by adding Subchapter J to read as follows:
1414 SUBCHAPTER J. BICENTENNIAL TRAIL
1515 Sec. 31.501. DEFINITION. In this subchapter, "hike and
1616 bike trail" means a trail designed for the exclusive use of
1717 pedestrians and bicyclists.
1818 Sec. 31.5011. ESTABLISHMENT OF BICENTENNIAL TRAIL. (a)
1919 The land office shall coordinate the establishment of a hike and
2020 bike trail network for the purposes described by Section 31.502,
2121 with connections as described by that section, to be known as the
2222 Bicentennial Trail.
2323 (b) The land office shall undertake to ensure that the
2424 Bicentennial Trail is established on or before January 1, 2036.
2525 (c) As necessary or convenient to coordinate the
2626 establishment of the Bicentennial Trail, the land office shall
2727 enter into memoranda of understanding with:
2828 (1) political subdivisions, nonprofit organizations,
2929 the Texas Department of Transportation, and other persons as
3030 necessary to establish and maintain the trail; and
3131 (2) the Parks and Wildlife Department:
3232 (A) to acquire real property or interests in real
3333 property as necessary to complete the trail routes; and
3434 (B) concerning other matters related to the
3535 establishment of the trail or the maintenance of the trail and
3636 property associated with the trail.
3737 (d) A memorandum of understanding entered into under
3838 Subsection (c) may address:
3939 (1) coordination of trail development;
4040 (2) trail maintenance;
4141 (3) acquisition of interests in real property;
4242 (4) conservation efforts along the trail routes; or
4343 (5) any other matter pertinent to the establishment or
4444 maintenance of the trail.
4545 (e) The land office may adopt rules as necessary to
4646 coordinate the establishment of the Bicentennial Trail, including a
4747 timeline for the acquisition of real property and real property
4848 interests as necessary to complete the trail route.
4949 (f) Real property or interests in real property necessary to
5050 complete the trail routes may not be acquired through eminent
5151 domain.
5252 (g) This section expires September 1, 2037.
5353 Sec. 31.502. BICENTENNIAL TRAIL PURPOSES. The Bicentennial
5454 Trail is established as a network of hike and bike trails to connect
5555 the Alamo to the State Capitol and to include hike and bike trail
5656 connections to Barton Springs, San Marcos Springs, Comal Springs,
5757 and San Antonio Springs for the purposes of promoting outdoor
5858 recreation, environmental stewardship, and the historical and
5959 cultural heritage of this state.
6060 Sec. 31.503. USE OF BICENTENNIAL TRAIL PROPERTY. Real
6161 property acquired by this state for the Bicentennial Trail may be
6262 used only for the purposes of the Bicentennial Trail.
6363 Sec. 31.504. BICENTENNIAL TRAIL MAINTENANCE. The Parks and
6464 Wildlife Department shall maintain any real property acquired by
6565 this state for the Bicentennial Trail.
6666 SECTION 2. The expiration of Section 31.5011, Natural
6767 Resources Code, as added by this Act, does not affect the validity
6868 of a memorandum of understanding entered into under that section.
6969 SECTION 3. This Act takes effect September 1, 2025.
