| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Subchapter B, Chapter 91, Natural Resources | |
| 14 | 14 | Code, is amended by adding Section 91.021 to read as follows: | |
| 15 | 15 | Sec. 91.021. MAINTENANCE OF CERTAIN IMPROVEMENTS. (a) An | |
| 16 | 16 | operator of a well drilled for oil or gas shall maintain in | |
| 17 | 17 | accordance with rules adopted by the commission all land and | |
| 18 | 18 | infrastructure that is: | |
| 19 | 19 | (1) associated with operations incident to oil and gas | |
| 20 | 20 | development production; and | |
| 21 | 21 | (2) located between the wellhead and a highway, as | |
| 22 | 22 | defined by Section 366.003, Transportation Code. | |
| 23 | 23 | (b) If the commission determines that a person has violated | |
| 24 | 24 | a rule adopted under this section, the commission shall assess a | |
| 25 | 25 | penalty against the person in the manner provided by Sections | |
| 26 | 26 | 81.0532 through 81.0534 for assessing an administrative penalty | |
| 27 | 27 | under Section 81.0531. | |
| 28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
