77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of certain counties to employ a county
1010 purchasing agent.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 262.0115, Local Government Code, is
1313 amended by amending Subsection (a) and adding Subsection (f) to
1414 read as follows:
1515 (a) In a county with a population of more than 100,000, the
1616 commissioners court may employ a person to act as county purchasing
1717 agent. Except as provided by Subsection (f) [However], this
1818 section does not apply to a county that has appointed a purchasing
1919 agent under Section 262.011 and that has not abolished the position
2020 as authorized by law.
2121 (f) This subsection applies only to a county for which the
2222 board described by Section 262.011 has either appointed a county
2323 purchasing agent and not abolished that office, or has abolished
2424 that office. The commissioners court of the county, after a public
2525 hearing held on the matter, by order may employ a county purchasing
2626 agent, regardless of whether the board has appointed another county
2727 purchasing agent under Section 262.011. If the commissioners court
2828 employs a county purchasing agent under this subsection, the board
2929 shall:
3030 (1) if applicable, remove the county purchasing agent
3131 appointed by the board from office; and
3232 (2) transfer complete authority over the county
3333 purchasing agent to the commissioners court.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
