46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to scholarly research and grant applications at public
79 institutions of higher education.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 51.3525(d), Education Code, is amended
1012 by amending Subsection (d)(2), adding Subsection (d)(3), and
1113 renumbering subsequent sections to read as follows:
1214 (d) Subsection (b)(1) may not be construed to apply to:
1315 (1) academic course instruction;
1416 (2) scholarly research, including research funded or
1517 to be funded wholly or partly by government or private grants, or a
1618 creative work by an institution of higher education's students,
1719 faculty, postdoctoral fellows, or other research personnel or the
1820 dissemination of that research or work;
1921 (3) information or guidance by faculty or staff on
2022 career opportunities and grant applications;
2123 (34) an activity of a student organization registered
2224 with or recognized by an institution of higher education;
2325 (45) guest speakers or performers on short-term
2426 engagements;
2527 (56) a policy, practice, procedure, program, or
2628 activity to enhance student academic achievement or postgraduate
2729 outcomes that is designed and implemented without regard to race,
2830 sex, color, or ethnicity;
2931 (67) data collection; or
3032 (78) student recruitment or admissions.
3133 SECTION 3. This Act takes effect immediately if it receives
3234 a vote of two-thirds of all the members elected to each house, as
3335 provided by Section 39, Article III, Texas Constitution. If this
3436 Act does not receive the vote necessary for immediate effect, this
3537 Act takes effect September 1, 2025.
