| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 51.3525(d), Education Code, is amended |
|---|
| 10 | 12 | | by amending Subsection (d)(2), adding Subsection (d)(3), and |
|---|
| 11 | 13 | | renumbering subsequent sections to read as follows: |
|---|
| 12 | 14 | | (d) Subsection (b)(1) may not be construed to apply to: |
|---|
| 13 | 15 | | (1) academic course instruction; |
|---|
| 14 | 16 | | (2) scholarly research, including research funded or |
|---|
| 15 | 17 | | to be funded wholly or partly by government or private grants, or a |
|---|
| 16 | 18 | | creative work by an institution of higher education's students, |
|---|
| 17 | 19 | | faculty, postdoctoral fellows, or other research personnel or the |
|---|
| 18 | 20 | | dissemination of that research or work; |
|---|
| 19 | 21 | | (3) information or guidance by faculty or staff on |
|---|
| 20 | 22 | | career opportunities and grant applications; |
|---|
| 21 | 23 | | (34) an activity of a student organization registered |
|---|
| 22 | 24 | | with or recognized by an institution of higher education; |
|---|
| 23 | 25 | | (45) guest speakers or performers on short-term |
|---|
| 24 | 26 | | engagements; |
|---|
| 25 | 27 | | (56) a policy, practice, procedure, program, or |
|---|
| 26 | 28 | | activity to enhance student academic achievement or postgraduate |
|---|
| 27 | 29 | | outcomes that is designed and implemented without regard to race, |
|---|
| 28 | 30 | | sex, color, or ethnicity; |
|---|
| 29 | 31 | | (67) data collection; or |
|---|
| 30 | 32 | | (78) student recruitment or admissions. |
|---|
| 31 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 37 | | Act takes effect September 1, 2025. |
