77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to identification cards issued by health maintenance
1010 organizations and preferred provider organizations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 843.209, Insurance Code, is amended to
1313 read as follows:
1414 Sec. 843.209. IDENTIFICATION CARD. (a) An identification
1515 card or other similar document issued by a health maintenance
1616 organization to an enrollee must:
1717 (1) indicate that the health maintenance organization
1818 is regulated under this code and subject to the provisions of
1919 Subchapter J; [and]
2020 (2) display:
2121 (A) the first date on which the enrollee became
2222 enrolled; or
2323 (B) a toll-free number a physician or provider
2424 may use to obtain that date; and
2525 (3) display the acronym "HMO" in the location of the
2626 health maintenance organization's choice.
2727 (b) An identification card or other similar document that
2828 bears the acronym "HMO" as required by Subsection (a) indicates
2929 that health benefit coverage for health care services provided by a
3030 participating physician or provider does not ensure the enrollee
3131 has access to:
3232 (1) health care services at a discounted rate if the
3333 services are provided by a physician or provider who is not included
3434 in the health maintenance organization delivery network; or
3535 (2) other fee discounts available under the health
3636 maintenance organization delivery network.
3737 SECTION 2. Section 1301.162, Insurance Code, is amended to
3838 read as follows:
3939 Sec. 1301.162. IDENTIFICATION CARD. (a) An identification
4040 card or other similar document issued by an insurer regulated by
4141 this code and subject to this chapter to an individual insured must:
4242 (1) display:
4343 (A) [(1)] the first date on which the individual
4444 became insured under the plan; or
4545 (B) [(2)] a toll-free number a physician or
4646 health care provider may use to obtain that date; and
4747 (2) display the acronym "PPO" in the location of the
4848 insurer's choice.
4949 (b) An identification card or other similar document that
5050 bears the acronym "PPO" as required by Subsection (a) indicates
5151 that health benefit coverage for medical care or health care
5252 services provided by a preferred provider does not ensure the
5353 insured has access to:
5454 (1) medical care or health care services at a
5555 discounted rate if the services are provided by an out-of-network
5656 provider; or
5757 (2) other fee discounts available under the provider
5858 network.
5959 SECTION 3. Sections 843.209 and 1301.162, Insurance Code,
6060 as amended by this Act, apply only to an identification card or
6161 other similar document issued on or after January 1, 2026.
6262 SECTION 4. This Act takes effect September 1, 2025.
