77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the terminology used to refer to certain disabilities
1010 in determining eligibility for special education services in public
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 29.003, Education Code, is amended by
1414 amending Subsection (b) and adding Subsection (c) to read as
1515 follows:
1616 (b) A student is eligible to participate in a school
1717 district's special education program if the student:
1818 (1) is not more than 21 years of age and has a visual or
1919 auditory impairment that prevents the student from being adequately
2020 or safely educated in public school without the provision of
2121 special services; or
2222 (2) is at least three but not more than 21 years of age
2323 and has one or more of the following disabilities that prevents the
2424 student from being adequately or safely educated in public school
2525 without the provision of special services:
2626 (A) physical disability;
2727 (B) intellectual or developmental disability;
2828 (C) emotional dysregulation [disturbance];
2929 (D) learning disability;
3030 (E) autism;
3131 (F) speech disability; or
3232 (G) traumatic brain injury.
3333 (c) In this section, "emotional dysregulation" has the
3434 meaning assigned to the term "emotional disturbance" by 34 C.F.R.
3535 Section 300.8(c)(4).
3636 SECTION 2. This Act takes effect September 1, 2025.
