| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 140, Local Government Code, is amended |
|---|
| 13 | 13 | | by adding Section 140.014 to read as follows: |

| 14 | 14 | | Sec. 140.014. FEE FOR CLIMATE OR ENVIRONMENTAL PROJECT |
|---|
| 15 | 15 | | PROHIBITED. (a) In this section: |
|---|
| 16 | 16 | | (1) "Climate or environmental project" means a project |
|---|
| 17 | 17 | | undertaken by a political subdivision to reduce greenhouse gas |
|---|
| 18 | 18 | | emissions, mitigate the impacts of climate change, adapt to the |
|---|
| 19 | 19 | | effects of climate change, reduce the amount of pollutants reaching |
|---|
| 20 | 20 | | the environment, or contribute to public awareness of related |
|---|
| 21 | 21 | | matters. The term does not include basic sanitation or waste |
|---|
| 22 | 22 | | disposal services provided by a political subdivision. |
|---|
| 23 | 23 | | (2) "Fee" includes any fee, charge, assessment, or |
|---|
| 24 | 24 | | similar payment required by a political subdivision for a |
|---|
| 25 | 25 | | privilege, service, authorization, permit, license, registration, |
|---|
| 26 | 26 | | certification, filing, or other action or approval by the political |
|---|
| 27 | 27 | | subdivision. |
|---|
| 28 | 28 | | (b) A political subdivision may not impose a fee to fund a |
|---|
| 29 | 29 | | climate or environmental project. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2025. |
