| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 271, Local Government |
|---|
| 13 | 13 | | Code, is amended by adding Section 271.909 to read as follows: |
|---|
| 14 | 14 | | Sec. 271.909. CERTAIN CONTRACTING PREFERENCES PROHIBITED. |
|---|
| 15 | 15 | | (a) In this section, "company" means a sole proprietorship, |
|---|
| 16 | 16 | | organization, association, corporation, partnership, joint |
|---|
| 17 | 17 | | venture, limited partnership, limited liability partnership, or |
|---|
| 18 | 18 | | limited liability company, including a wholly owned subsidiary, |
|---|
| 19 | 19 | | majority-owned subsidiary, parent company, or affiliate of those |
|---|
| 20 | 20 | | entities or business associations, that exists to make a profit. |
|---|
| 21 | 21 | | (b) Notwithstanding any other law, a political subdivision |
|---|
| 22 | 22 | | may not disqualify in any way a vendor in a contractor selection |
|---|
| 23 | 23 | | process because the vendor: |
|---|
| 24 | 24 | | (1) is a company that engages in the exploration, |
|---|
| 25 | 25 | | production, use, transportation, sale, or manufacturing of fossil |
|---|
| 26 | 26 | | fuel-based energy; or |
|---|
| 27 | 27 | | (2) invests in, assists in, or does business with a |
|---|
| 28 | 28 | | company described by Subdivision (1). |
|---|
| 29 | 29 | | SECTION 2. Section 271.909, Local Government Code, as added |
|---|
| 30 | 30 | | by this Act, applies only to a contractor selection process |
|---|
| 31 | 31 | | initiated on or after the effective date of this Act. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
|---|
