| 10 | 10 | | restrict the use of a certain mode of transportation on a roadway. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter E, Chapter 251, Transportation Code, |
|---|
| 13 | 13 | | is amended by adding Section 251.162 to read as follows: |
|---|
| 14 | 14 | | Sec. 251.162. PROHIBITION OR RESTRICTION OF CERTAIN MODES |
|---|
| 15 | 15 | | OF TRANSPORTATION PROHIBITED. The commissioners court of a county |
|---|
| 16 | 16 | | may not: |
|---|
| 17 | 17 | | (1) prohibit the use of a certain mode of |
|---|
| 18 | 18 | | transportation on a roadway that is not otherwise prohibited on |
|---|
| 19 | 19 | | that roadway under or as required by state law; or |
|---|
| 20 | 20 | | (2) impose a fine for the use of a certain mode of |
|---|
| 21 | 21 | | transportation on a roadway. |

| 22 | 22 | | SECTION 2. Subchapter Z, Chapter 311, Transportation Code, |
|---|
| 23 | 23 | | is amended by adding Section 311.905 to read as follows: |
|---|
| 24 | 24 | | Sec. 311.905. PROHIBITION OR RESTRICTION OF CERTAIN MODES |
|---|
| 25 | 25 | | OF TRANSPORTATION PROHIBITED. The governing body of a municipality |
|---|
| 26 | 26 | | may not: |
|---|
| 27 | 27 | | (1) prohibit the use of a certain mode of |
|---|
| 28 | 28 | | transportation on a roadway that is not otherwise prohibited on |
|---|
| 29 | 29 | | that roadway under or as required by state law; or |
|---|
| 30 | 30 | | (2) impose a fine for the use of a certain mode of |
|---|
| 31 | 31 | | transportation on a roadway. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
