66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to protecting parents and other individuals from criminal
99 investigations or prosecution for refusing to affirm a child's
1010 homosexual or transgender inclinations or efforts to obtain an
1111 abortion.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 22.04, Penal Code, is amended by adding
1414 Subsection (n) to read as follows:
1515 (n) This section may not be construed to impose criminal
1616 liability on any person for criticizing, opposing, attempting to
1717 change, or refusing to affirm, accept, accommodate, or express
1818 approval of another person's:
1919 (1) homosexual inclinations or behavior;
2020 (2) transgender or gender non-conforming inclinations
2121 or behavior; or
2222 (3) efforts or decision to obtain an abortion.
2323 SECTION 2. Section 22.04, Penal Code, is amended by adding
2424 Subsection (i) to read as follows:
2525 (i) This section may not be construed to impose criminal
2626 liability on any person for criticizing, opposing, attempting to
2727 change, or refusing to affirm, accept, accommodate, or express
2828 approval of another person's:
2929 (1) homosexual inclinations or behavior;
3030 (2) transgender or gender non-conforming inclinations
3131 or behavior; or
3232 (3) efforts or decision to obtain an abortion.
3333 SECTION 3. If any provision of this Act or its application
3434 to any person or circumstance is held invalid, the invalidity does
3535 not affect other provisions or applications of this Act that can be
3636 given effect without the invalid provision or application, and to
3737 this end the provisions of this Act are declared to be severable.
3838 SECTION 4. This Act takes effect September 1, 2025.
