9 | 9 | relating to the establishment of service credit in the Teacher | |
10 | 10 | Retirement System of Texas for certain military service by members | |
11 | 11 | of the Texas National Guard. | |
12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 823.301(a), Government Code, is amended | |
14 | 14 | to read as follows: | |
15 | 15 | (a) Military [Except as provided by Section 823.101(2), | |
16 | 16 | military] service creditable in the retirement system is: | |
17 | 17 | (1) active federal duty in the armed forces of the | |
18 | 18 | United States, other than as a student at a service academy, that | |
19 | 19 | was performed: | |
20 | 20 | (A) [(1)] as a direct result of being inducted or | |
21 | 21 | of first enlisting for duty on a date when the federal government | |
22 | 22 | was actively inducting persons into the armed forces under federal | |
23 | 23 | draft laws; | |
24 | 24 | (B) [(2)] as a reservist or member of the | |
25 | 25 | national guard who was ordered to duty under the authority of | |
26 | 26 | federal law; | |
27 | 27 | (C) [(3)] during a time when the federal | |
28 | 28 | government was actively inducting persons into the armed forces | |
29 | 29 | under federal draft laws; or | |
30 | 30 | (D) [(4)] as a result of voluntarily entering on | |
31 | 31 | active duty; or | |
32 | 32 | (2) state active duty in the Texas National Guard, as | |
33 | 33 | those terms are defined by Section 437.001. | |
34 | 34 | SECTION 2. This Act takes effect September 1, 2025. |
