129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 82.0651(d), Government Code, is amended
1411 to read as follows:
1512 (d) A person who prevails in an action under Subsection (c)
1613 shall recover from each person who engaged in barratry:
17- (1) a penalty in the amount of $50,000 [$10,000];
14+ (1) a penalty in the amount of $50,000 [10,000];
1815 (2) actual damages caused by the prohibited conduct;
1916 and
2017 (3) reasonable and necessary attorney's fees.
21- SECTION 2. Section 82.0651(d), Government Code, as amended
22- by this Act, applies only to an action filed on or after the
23- effective date of this Act. An action filed before the effective
24- date of this Act is governed by the law in effect on the date the
25- action was filed, and that law is continued in effect for that
26- purpose.
18+ SECTION 2. The change in law made by this Act applies to a
19+ cause of action filed on or after the effective date. An action
20+ filed before the effective date of this Act is governed by the law
21+ in effect on the date the action was filed, and the former law is
22+ continued in effect for that purpose.
2723 SECTION 3. This Act takes effect September 1, 2025.
