| 12 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 10 | SECTION 1. Section 82.0651(d), Government Code, is amended | |
| 14 | 11 | to read as follows: | |
| 15 | 12 | (d) A person who prevails in an action under Subsection (c) | |
| 16 | 13 | shall recover from each person who engaged in barratry: | |
| 17 | - | (1) a penalty in the amount of $50,000 [ | |

| 24 | - | date of this Act is governed by the law in effect on the date the | |
| 25 | - | action was filed, and that law is continued in effect for that | |
