77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the emergency possession of a newborn by employees of a
1010 hospital.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 262.302(a), Family Code, is amended to
1313 read as follows:
1414 (a) A designated emergency infant care provider shall,
1515 without a court order, take possession of a child who appears to be
1616 60 days old or younger if:
1717 (1) the child is voluntarily delivered to the provider
1818 by the child's parent by:
1919 (A) leaving the child with an employee of the
2020 provider, including surrendering a child to an employee of a
2121 hospital immediately after giving birth to the child; or
2222 (B) placing the child in a newborn safety device
2323 located inside the provider's facilities; and
2424 (2) the parent did not express an intent to return for
2525 the child.
2626 SECTION 2. This Act takes effect September 1, 2025.
