| 9 | 9 | | relating to the regulation of pilots for the ports of Harris County |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 66.002(3), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (3) "Harris County port" means a place in Harris or |
|---|
| 15 | 15 | | Chambers County into which a vessel using the Houston Ship Channel |
|---|
| 16 | 16 | | enters or from which a vessel using the Houston Ship Channel |
|---|
| 17 | 17 | | departs, and the waterway leading to that place from the Gulf of |
|---|
| 18 | 18 | | Mexico. |
|---|
| 19 | 19 | | SECTION 2. Section 66.012, Transportation Code, is amended |
|---|
| 20 | 20 | | to read as follows: |
|---|
| 21 | 21 | | Sec. 66.012. PROHIBITED INTEREST. A person may not be a |
|---|
| 22 | 22 | | member of the board if the person, directly or indirectly, is |
|---|
| 23 | 23 | | engaged in or has an interest in any [pilot boat or in any other] |
|---|
| 24 | 24 | | business that may adversely affect [affected by or connected with] |
|---|
| 25 | 25 | | the performance of the person's duties as a pilot commissioner. |
|---|
| 26 | 26 | | SECTION 3. Section 66.040(b), Transportation Code, is |
|---|
| 27 | 27 | | amended to read as follows: |
|---|
| 28 | 28 | | (b) A deputy branch pilot's certificate expires on the |
|---|
| 29 | 29 | | fourth [third] anniversary of the date it is issued and may [not] be |
|---|
| 30 | 30 | | renewed as provided by Section 66.042. |
|---|
| 31 | 31 | | SECTION 4. Section 66.042, Transportation Code, is amended |
|---|
| 32 | 32 | | to read as follows: |
|---|
| 33 | 33 | | Sec. 66.042. DEPUTY BRANCH PILOT'S CERTIFICATE RENEWAL |
|---|
| 34 | 34 | | [PILOT]. A person who has been issued a deputy branch pilot's |
|---|
| 35 | 35 | | certificate may apply to renew the certificate if the deputy branch |
|---|
| 36 | 36 | | pilot is reappointed by a branch pilot as provided by Section 66.038 |
|---|
| 37 | 37 | | [not be issued a deputy branch pilot's certificate before the fifth |
|---|
| 38 | 38 | | anniversary of the date the person was previously issued a deputy |
|---|
| 39 | 39 | | branch pilot's certificate]. |

| 40 | 40 | | SECTION 5. This Act takes effect September 1, 2025. |
