88 AN ACT
99 relating to battery energy storage facilities; authorizing fees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 35, Utilities Code, is amended by adding
1212 Subchapter F to read as follows:
1313 SUBCHAPTER F. BATTERY ENERGY STORAGE FACILITY PERMIT
1414 Sec. 35.201. DEFINITIONS; APPLICABILITY. (a) In this
1515 subchapter:
1616 (1) "Battery energy storage facility" includes
1717 lithium ion battery energy storage and a facility or equipment used
1818 to support the operation of lithium ion battery energy storage,
1919 including an underground or aboveground electrical transmission or
2020 communications line, or an electric transformer.
2121 (2) "Permit holder" means a person who holds a permit
2222 issued under this subchapter.
2323 (3) "Person" includes an electric cooperative and a
2424 municipally owned utility.
2525 (b) This subchapter applies only to a battery energy storage
2626 facility that is intended to be used to sell energy or ancillary
2727 services at wholesale.
2828 Sec. 35.202. PERMIT REQUIRED. (a) A person may not
2929 interconnect a battery energy storage facility to a transmission
3030 facility unless the person holds a permit to operate a battery
3131 energy storage facility issued by the commission under this
3232 subchapter.
3333 (b) The commission by rule shall require each permitted
3434 battery energy storage facility to comply with the rules adopted by
3535 the state fire marshal under Section 35.203.
3636 (c) The commission by rule shall adopt a fee to be imposed on
3737 each permit applicant to cover the commission's costs associated
3838 with implementing this subchapter.
3939 (d) For purposes of this subchapter:
4040 (1) a provision of Subchapter B or E, Chapter 14, that
4141 authorizes the commission to regulate a public utility also applies
4242 to a person required to obtain a permit under this section,
4343 including an electric cooperative or a municipally owned utility;
4444 and
4545 (2) a reference in Chapter 15 to a person includes a
4646 person required to obtain a permit under this section, including an
4747 electric cooperative or a municipally owned utility.
4848 Sec. 35.203. FIRE SAFETY STANDARDS FOR BATTERY ENERGY
4949 STORAGE FACILITIES. (a) The state fire marshal shall adopt and
5050 periodically update fire safety standards for a battery energy
5151 storage facility operating under a permit issued under this
5252 subchapter. The standards must include:
5353 (1) minimum distances between battery energy storage
5454 facilities and buildings and critical infrastructure;
5555 (2) requirements for fireproof barriers to protect
5656 other structures and vegetation;
5757 (3) minimum standards related to the installation,
5858 design, and maintenance of battery energy storage facilities and
5959 related electrical equipment, including ventilation and cooling;
6060 (4) fire hazard management standards, including
6161 standards for emergency shutdown systems;
6262 (5) lithium ion battery safety standards, including
6363 standards for specialized fire suppression equipment; and
6464 (6) standards for signage near a battery energy
6565 storage facility.
6666 (b) Each permit holder that owns or operates a permitted
6767 battery energy storage facility shall ensure that the facility
6868 meets the fire safety standards adopted by the state fire marshal
6969 under Subsection (a) at the time of interconnection.
7070 Sec. 35.204. EMERGENCY OPERATIONS PLANS FOR BATTERY ENERGY
7171 STORAGE FACILITIES. (a) A permit holder shall collaborate with
7272 local fire departments to develop a site-specific emergency
7373 operations plan for each battery energy storage facility owned or
7474 operated by the permit holder, including emergency response and
7575 communications protocols for an equipment failure incident.
7676 (b) The permit holder shall offer to local fire departments
7777 training regarding responding to a fire at the battery energy
7878 storage facility, including specialized training for hazards
7979 related to characteristics of lithium ion battery fires and related
8080 to responding to a fire at a battery energy storage facility that is
8181 integrated with a solar power generation facility.
8282 Sec. 35.205. FIRE DEPARTMENT RESPONSE FUNDING. (a) An
8383 applicant for a permit under this subchapter shall obtain from the
8484 fire department, as defined by Section 419.021, Government Code,
8585 volunteer fire department, fire marshal, or other first responder
8686 entity that may reasonably be expected to be the primary first
8787 responder to a fire at the location of the battery energy storage
8888 facility an estimate of the expenses required for the first
8989 responder entity to adequately prepare to respond to a fire at the
9090 battery energy storage facility during the first year after the
9191 date the facility is installed.
9292 (b) The estimated amount of expenses under Subsection (a)
9393 may not include expenses the first responder entity would incur
9494 regardless of the existence of the battery energy storage facility.
9595 (c) The commission shall require the applicant to deposit
9696 with the comptroller under Subsection (d) an amount of money the
9797 commission determines is sufficient to compensate the first
9898 responder entity for expenses required for the first responder
9999 entity to adequately prepare to respond to a fire at the battery
100100 energy storage facility during the first year after the date the
101101 facility is installed. The applicant shall provide the estimate
102102 described by Subsection (a) to the commission, who shall consider
103103 the estimate in determining the amount of money required to be
104104 deposited under Subsection (d).
105105 (d) The comptroller shall deposit money received from an
106106 applicant for the purposes of this section in a separate suspense
107107 account to be held in trust for the first responder entity. The
108108 suspense account is outside the state treasury and the comptroller
109109 may make a payment authorized by this subchapter without the
110110 necessity of an appropriation.
111111 (e) After the commission approves the permit application:
112112 (1) the commission shall notify the comptroller of the
113113 approval; and
114114 (2) the comptroller shall pay to the first responder
115115 entity the amount deposited by the permit applicant for that first
116116 responder entity.
117117 Sec. 35.206. PUBLIC AWARENESS CAMPAIGN. A permit holder
118118 shall develop a public awareness campaign to educate the public in
119119 the area of the permitted battery energy storage facility about
120120 specific risks and safety measures related to the battery energy
121121 storage facility.
122122 SECTION 2. The changes in law made by this Act apply only to
123123 a battery energy storage facility interconnected on or after the
124124 effective date of this Act.
125125 SECTION 3. This Act takes effect September 1, 2025.
