| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 441.1035, Government Code, is amended to |

| 13 | 15 | | PHYSICAL FORMAT. (a) A state agency that distributes by |
|---|
| 14 | 16 | | subscription a state publication in a physical format, such as |
|---|
| 15 | 17 | | paper, tape, or disk, and without a fee or other cost to the |
|---|
| 16 | 18 | | subscriber shall make the publication accessible in an electronic |
|---|
| 17 | 19 | | format from the agency's Internet website. |
|---|
| 18 | 20 | | (b) A state agency that makes a state publication accessible |
|---|
| 19 | 21 | | on its Internet website must inform each subscriber to the |
|---|
| 20 | 22 | | publication that the subscriber may, instead of accessing the |
|---|
| 21 | 23 | | publication at the agency's Internet website, receive a physical |
|---|
| 22 | 24 | | copy of the publication [When distributing a state publication in a |
|---|
| 23 | 25 | | physical format, a state agency that makes the publication |
|---|
| 24 | 26 | | accessible on its Internet website must inform each subscriber to |
|---|
| 25 | 27 | | the publication that the subscriber may, instead of receiving a |
|---|
| 26 | 28 | | physical copy, access the publication at the agency's Internet |
|---|
| 27 | 29 | | website]. |

| 28 | 30 | | (c) If a subscriber prefers to receive [access] a |
|---|
| 29 | 31 | | publication in physical format [at the state agency's Internet |
|---|
| 30 | 32 | | website] and notifies the agency of that preference, the agency |
|---|
| 31 | 33 | | shall [: |

| 32 | 34 | | [(1)] add [remove] the subscriber to [from] the |
|---|
| 33 | 35 | | distribution list for that publication[; and |
|---|
| 34 | 36 | | [(2) notify the subscriber electronically each time |
|---|
| 35 | 37 | | the publication becomes available at the agency's Internet website |
|---|
| 36 | 38 | | and provide an electronic link to the publication]. |
|---|
| 37 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 38 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 43 | | Act takes effect September 1, 2025. |
