88 AN ACT
99 relating to prohibiting the retention of certain genetic material
1010 and genetic information by the Department of Family and Protective
1111 Services.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 40, Human Resources Code,
1414 is amended by adding Section 40.084 to read as follows:
1515 Sec. 40.084. RETENTION OF GENETIC INFORMATION PROHIBITED.
1616 (a) In this section:
1717 (1) "DNA" means deoxyribonucleic acid.
1818 (2) "Genetic information" means information related
1919 to the genetic characteristics of an individual or the individual's
2020 family that is derived from the results of a genetic analysis.
2121 (3) "Genetic material" means blood or another specimen
2222 that contains DNA.
2323 (b) The department shall promptly destroy any genetic
2424 material and delete any genetic information obtained from an
2525 individual for the purpose of determining paternity after the
2626 purpose for which the sample was obtained is accomplished.
2727 SECTION 2. Not later than January 1, 2026, the Department of
2828 Family and Protective Services shall destroy all genetic material
2929 and delete genetic information as required by Section 40.084, Human
3030 Resources Code, as added by this Act.
3131 SECTION 3. This Act takes effect September 1, 2025.
