12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Subchapter C, Chapter 40, Human Resources Code, | |
14 | 14 | is amended by adding Section 40.084 to read as follows: | |
15 | 15 | Sec. 40.084. RETENTION OF GENETIC INFORMATION PROHIBITED. | |
16 | 16 | (a) In this section: | |
17 | 17 | (1) "DNA" means deoxyribonucleic acid. | |
18 | 18 | (2) "Genetic information" means information related | |
19 | 19 | to the genetic characteristics of an individual or the individual's | |
20 | 20 | family that is derived from the results of a genetic analysis. | |
21 | 21 | (3) "Genetic material" means blood or another specimen | |
22 | 22 | that contains DNA. | |
23 | 23 | (b) The department shall promptly destroy any genetic | |
24 | 24 | material and delete any genetic information obtained from an | |
25 | 25 | individual for the purpose of determining paternity after the | |
26 | 26 | purpose for which the sample was obtained is accomplished. | |
27 | 27 | SECTION 2. Not later than January 1, 2026, the Department of | |
28 | 28 | Family and Protective Services shall destroy all genetic material | |
29 | 29 | and delete genetic information as required by Section 40.084, Human | |
30 | 30 | Resources Code, as added by this Act. | |
31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
