77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to residence for purposes of voting.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1.015, Election Code, is amended by
1212 adding Subsections (c-1), (c-2), (g), and (h) to read as follows:
1313 (c-1) A person is considered to have left the person's home
1414 for more than temporary purposes if the person does not reside at
1515 the person's home for at least 180 days in a calendar year.
1616 (c-2) Subsection (c-1) does not apply to a person:
1717 (1) who is a member of the armed forces of the United
1818 States or the spouse or a dependent of a member;
1919 (2) enrolled as a full-time student who lives on
2020 campus at an institution of higher education; or
2121 (3) who is a member of the legislature or the United
2222 States Congress.
2323 (g) Except as provided by Subsection (h), a person who
2424 maintains more than one place of residence may not establish
2525 residence at a place that is a commercial building or a recreational
2626 vehicle.
2727 (h) The voter registrar may determine that a recreational
2828 vehicle is a person's residence with consideration of the address
2929 listed on:
3030 (1) a driver's license or other identification card
3131 issued to the person by the Department of Public Safety that has not
3232 expired;
3333 (2) a license to carry a concealed handgun issued to
3434 the person by the Department of Public Safety that has not expired;
3535 (3) a utility bill addressed to the person at the
3636 address of the person's established residence; or
3737 (4) an official tax document or Texas Department of
3838 Motor Vehicles document showing the registration address of a
3939 vehicle the person owns.
4040 SECTION 2. The changes in law made by this Act apply only to
4141 an election held on or after the effective date of this Act.
4242 SECTION 3. This Act takes effect September 1, 2025.
