10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 21.001, Government Code, is amended by | |
12 | 12 | adding Subsections (d) and (e) to read as follows: | |
13 | 13 | (d) A person holding judicial office may not abandon, | |
14 | 14 | abdicate, or otherwise relinquish the person's judicial authority | |
15 | 15 | or duties vested in the office by the Texas Constitution, a state | |
16 | 16 | statute, or the Code of Judicial Conduct. | |
17 | 17 | (e) A person holding judicial office is subject to Section | |
18 | 18 | 1-a, Article V, Texas Constitution, and the Code of Judicial | |
19 | 19 | Conduct regardless of whether the court the person serves has civil | |
20 | 20 | or criminal jurisdiction. | |
21 | 21 | SECTION 2. Subchapter B, Chapter 81, Local Government Code, | |
22 | 22 | is amended by adding Section 81.0292 to read as follows: | |
23 | 23 | Sec. 81.0292. PROHIBITED DELEGATION OF JUDICIAL AUTHORITY. | |
24 | 24 | A commissioners court of a county may not adopt or enforce an order, | |
25 | 25 | rule, or other measure that delegates the authority or duties | |
26 | 26 | vested in a judicial office except as specifically authorized by | |
27 | 27 | law. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2025. |
