9 | 9 | | relating to supplemental environmental projects authorized by the |

10 | 10 | | Texas Commission on Environmental Quality. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 7.067, Water Code, is amended by adding |
---|
13 | 13 | | Subsections (d), (e), and (f) to read as follows: |
---|
14 | 14 | | (d) The commission may determine the types of projects that |
---|
15 | 15 | | may be approved as a supplemental environmental project. For a |
---|
16 | 16 | | respondent that is a local government, those types of projects must |
---|
17 | 17 | | include: |
---|
18 | 18 | | (1) purchasing, operating, or maintaining: |
---|
19 | 19 | | (A) alternative fuel vehicles, including |
---|
20 | 20 | | passenger cars, light trucks, heavy trucks, and buses; and |
---|
21 | 21 | | (B) alternative fuel heavy equipment, including |
---|
22 | 22 | | tractors, bulldozers, front-end loaders, and motor graders; |
---|
23 | 23 | | (2) constructing, operating, or maintaining |
---|
24 | 24 | | alternative fuel refueling infrastructure necessary to operate an |
---|
25 | 25 | | alternative fuel fleet; and |
---|
26 | 26 | | (3) providing energy efficiency upgrades to buildings |
---|
27 | 27 | | and facilities owned by the local government, including heating, |
---|
28 | 28 | | ventilation, air conditioning, lighting, and building envelope |
---|
29 | 29 | | upgrades. |
---|
30 | 30 | | (e) For a supplemental environmental project involving |
---|
31 | 31 | | alternative fuel vehicles, the commission: |
---|
32 | 32 | | (1) must allow the project to include: |
---|
33 | 33 | | (A) the entire cost of the vehicle; and |
---|
34 | 34 | | (B) any alternative fuel equipment or upgrades |
---|
35 | 35 | | involved; and |
---|
36 | 36 | | (2) may not limit the project to including only the |
---|
37 | 37 | | difference in cost between conventional fuel vehicles, equipment, |
---|
38 | 38 | | or upgrades and the alternative fuel counterparts. |
---|
39 | 39 | | (f) The commission: |
---|
40 | 40 | | (1) may not require a contract associated with a |
---|
41 | 41 | | supplemental environmental project to be for a term of less than |
---|
42 | 42 | | five years; and |
---|
43 | 43 | | (2) must allow a contract associated with a |
---|
44 | 44 | | supplemental environmental project to be renewable for periods of |
---|
45 | 45 | | at least five years. |

46 | 46 | | SECTION 2. This Act takes effect September 1, 2025. |
