77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to supplemental environmental projects authorized by the
1010 Texas Commission on Environmental Quality.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 7.067, Water Code, is amended by adding
1313 Subsections (d), (e), and (f) to read as follows:
1414 (d) The commission may determine the types of projects that
1515 may be approved as a supplemental environmental project. For a
1616 respondent that is a local government, those types of projects must
1717 include:
1818 (1) purchasing, operating, or maintaining:
1919 (A) alternative fuel vehicles, including
2020 passenger cars, light trucks, heavy trucks, and buses; and
2121 (B) alternative fuel heavy equipment, including
2222 tractors, bulldozers, front-end loaders, and motor graders;
2323 (2) constructing, operating, or maintaining
2424 alternative fuel refueling infrastructure necessary to operate an
2525 alternative fuel fleet; and
2626 (3) providing energy efficiency upgrades to buildings
2727 and facilities owned by the local government, including heating,
2828 ventilation, air conditioning, lighting, and building envelope
2929 upgrades.
3030 (e) For a supplemental environmental project involving
3131 alternative fuel vehicles, the commission:
3232 (1) must allow the project to include:
3333 (A) the entire cost of the vehicle; and
3434 (B) any alternative fuel equipment or upgrades
3535 involved; and
3636 (2) may not limit the project to including only the
3737 difference in cost between conventional fuel vehicles, equipment,
3838 or upgrades and the alternative fuel counterparts.
3939 (f) The commission:
4040 (1) may not require a contract associated with a
4141 supplemental environmental project to be for a term of less than
4242 five years; and
4343 (2) must allow a contract associated with a
4444 supplemental environmental project to be renewable for periods of
4545 at least five years.
4646 SECTION 2. This Act takes effect September 1, 2025.
