77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a commission to coordinate celebrations of the
1010 bicentennial anniversary of Texas' independence.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle D, Title 4, Government Code, is amended
1313 by adding Chapter 452 to read as follows:
1414 CHAPTER 452. TEXAS 2036 BICENTENNIAL COMMISSION
1515 Sec. 452.001. DEFINITION. In this chapter, "commission"
1616 means the Texas 2036 Bicentennial Commission.
1717 Sec. 452.002. COMMISSION. (a) The Texas 2036 Bicentennial
1818 Commission is composed of the following 23 members appointed as
1919 follows:
2020 (1) nine members of the public appointed by the
2121 governor with the advice and consent of the senate;
2222 (2) three senators appointed by the lieutenant
2323 governor;
2424 (3) three members of the house of representatives
2525 appointed by the speaker of the house of representatives; and
2626 (4) the following ex officio members:
2727 (A) the executive head of the Texas Economic
2828 Development and Tourism Office within the office of the governor;
2929 (B) the executive director of the Texas
3030 Historical Commission;
3131 (C) the executive director of the Texas
3232 Commission on the Arts;
3333 (D) the director of the Texas Film Commission;
3434 (E) the commissioner of education;
3535 (F) the commissioner of higher education;
3636 (G) the director of the travel information
3737 division of the Texas Department of Transportation; and
3838 (H) the director of the Institute of Texan
3939 Cultures at The University of Texas at San Antonio.
4040 (b) The public members appointed by the governor must
4141 reflect the diverse geographic regions and population groups of
4242 this state.
4343 (c) Each member of the commission is a voting member. The
4444 duties performed by an ex officio member of the commission
4545 constitute additional duties of the underlying position that
4646 qualifies the member for service on the commission.
4747 (d) A member of the commission who is a senator or
4848 representative vacates the member's position if the member ceases
4949 to hold the underlying position that qualifies the member for
5050 service on the commission.
5151 (e) A public member shall serve until a successor is
5252 appointed and qualified.
5353 (f) A vacancy in the membership of the commission shall be
5454 filled for the unexpired term in the manner provided for the
5555 original appointment.
5656 Sec. 452.003. TERMS. Appointed members of the commission
5757 serve staggered six-year terms with the terms of three members
5858 appointed by the governor, one member appointed by the lieutenant
5959 governor, and one member appointed by the speaker of the house of
6060 representatives expiring on January 31 of each odd-numbered year.
6161 Sec. 452.004. PRESIDING OFFICER. (a) The governor shall
6262 appoint one member of the commission to serve as presiding officer.
6363 The presiding officer serves at the will of the governor.
6464 (b) If the presiding officer is absent from a meeting or is
6565 disabled, the members of the commission present at the meeting
6666 shall elect a temporary presiding officer by majority vote.
6767 Sec. 452.005. MEETINGS; QUORUM. (a) The commission shall
6868 meet at least quarterly and at other times at the call of the
6969 presiding officer or as provided by commission rule.
7070 (b) Chapter 551 applies to the commission.
7171 (c) Thirteen members of the commission constitute a quorum.
7272 Sec. 452.006. COMPENSATION; REIMBURSEMENT. (a) A member
7373 of the commission is not entitled to compensation for service on the
7474 commission but is entitled to reimbursement for actual and
7575 necessary expenses incurred in performing commission duties,
7676 subject to any applicable limitation on reimbursement provided by
7777 the General Appropriations Act.
7878 (b) A member appointed by the governor shall be reimbursed
7979 from the commission's funds. A member appointed by the lieutenant
8080 governor or speaker of the house of representatives shall be
8181 reimbursed from the appropriate fund of the member's chamber of the
8282 legislature. An ex officio member shall be reimbursed from the
8383 funds of the entity from which the member serves.
8484 Sec. 452.007. EXECUTIVE DIRECTOR; STAFF. (a) The
8585 commission may employ an executive director to serve as the
8686 executive head of the commission and perform its administrative
8787 functions.
8888 (b) The executive director may employ staff necessary to
8989 administer the commission.
9090 Sec. 452.008. POWERS AND DUTIES OF COMMISSION. The
9191 commission shall:
9292 (1) encourage individuals, private organizations, and
9393 local governmental bodies to organize activities celebrating the
9494 bicentennial of this state's independence;
9595 (2) assist individuals, private organizations, and
9696 local governmental bodies that organize bicentennial activities to
9797 coordinate the activities;
9898 (3) gather and disseminate information to the public
9999 about bicentennial activities conducted in the state;
100100 (4) develop standards for bicentennial activities
101101 organized by individuals, private organizations, and local
102102 governmental bodies and sanction activities that comply with the
103103 standards;
104104 (5) invite national and international dignitaries to
105105 attend and participate in bicentennial activities conducted in this
106106 state;
107107 (6) encourage persons living outside the state to
108108 attend bicentennial activities occurring in the state;
109109 (7) develop a logo to be used by the commission and
110110 permit other persons to use the logo if the commission considers the
111111 use appropriate; and
112112 (8) sanction products the commission may sell,
113113 including a commemorative calendar or flag, commemorating the
114114 state's bicentennial.
115115 Sec. 452.009. REPORT. Not later than September 1, 2037, the
116116 commission shall file a report with the governor and the
117117 legislature containing information about the effects of the
118118 bicentennial activities conducted in this state on the state's
119119 economy.
120120 Sec. 452.010. DONATIONS; GRANTS. The commission may
121121 solicit and accept, on behalf of the state, gifts, grants, and
122122 donations from any source to be used by the commission to perform
123123 its duties.
124124 Sec. 452.011. RULES. The commission may adopt rules
125125 necessary to perform its functions.
126126 Sec. 452.012. EXPIRATION. The commission is abolished and
127127 this chapter expires September 1, 2037.
128128 SECTION 2. (a) Not later than December 1, 2025, the
129129 governor, lieutenant governor, and speaker of the house of
130130 representatives shall appoint the initial members to the Texas 2036
131131 Bicentennial Commission in accordance with Section 452.002,
132132 Government Code, as added by this Act.
133133 (b) Notwithstanding Section 452.003, Government Code, as
134134 added by this Act, in making the initial appointments to the Texas
135135 2036 Bicentennial Commission under Subsection (a) of this section:
136136 (1) the governor shall designate three members for
137137 terms expiring January 31, 2027, three members for terms expiring
138138 January 31, 2029, and three members for terms expiring January 31,
139139 2031;
140140 (2) the lieutenant governor shall designate one member
141141 for a term expiring January 31, 2027, one member for a term expiring
142142 January 31, 2029, and one member for a term expiring January 31,
143143 2031; and
144144 (3) the speaker of the house of representatives shall
145145 designate one member for a term expiring January 31, 2027, one
146146 member for a term expiring January 31, 2029, and one member for a
147147 term expiring January 31, 2031.
148148 SECTION 3. This Act takes effect September 1, 2025.
