9 | 9 | | relating to the reporting of direct campaign expenditures by |

10 | 10 | | certain persons and political committees. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. This Act may be cited as the P.A.C. Transparency |
---|
13 | 13 | | and Accountability Act. |
---|
14 | 14 | | SECTION 2. Section 254.031(a), Election Code, is amended to |
---|
15 | 15 | | read as follows: |
---|
16 | 16 | | (a) Except as otherwise provided by this chapter, each |
---|
17 | 17 | | report filed under this chapter must include: |
---|
18 | 18 | | (1) the amount of political contributions, other than |
---|
19 | 19 | | political contributions described by Subdivision (1-a), from each |
---|
20 | 20 | | person that in the aggregate exceed $50 and that are accepted during |
---|
21 | 21 | | the reporting period by the person or committee required to file a |
---|
22 | 22 | | report under this chapter, the full name and address of the person |
---|
23 | 23 | | making the contributions, and the dates of the contributions; |
---|
24 | 24 | | (1-a) the amount of political contributions from each |
---|
25 | 25 | | person that are made electronically and that are accepted during |
---|
26 | 26 | | the reporting period by the person or committee required to file a |
---|
27 | 27 | | report under this chapter, the full name and address of the person |
---|
28 | 28 | | making the contributions, and the dates of the contributions; |
---|
29 | 29 | | (2) the amount of loans that are made during the |
---|
30 | 30 | | reporting period for campaign or officeholder purposes to the |
---|
31 | 31 | | person or committee required to file the report and that in the |
---|
32 | 32 | | aggregate exceed $50, the dates the loans are made, the interest |
---|
33 | 33 | | rate, the maturity date, the type of collateral for the loans, if |
---|
34 | 34 | | any, the full name and address of the person or financial |
---|
35 | 35 | | institution making the loans, the full name and address, principal |
---|
36 | 36 | | occupation, and name of the employer of each guarantor of the loans, |
---|
37 | 37 | | the amount of the loans guaranteed by each guarantor, and the |
---|
38 | 38 | | aggregate principal amount of all outstanding loans as of the last |
---|
39 | 39 | | day of the reporting period; |
---|
40 | 40 | | (3) the amount of political expenditures that in the |
---|
41 | 41 | | aggregate exceed $100 and that are made during the reporting |
---|
42 | 42 | | period, the full name and address of the persons to whom the |
---|
43 | 43 | | expenditures are made, and the dates and purposes of the |
---|
44 | 44 | | expenditures; |
---|
45 | 45 | | (4) the amount of each payment made during the |
---|
46 | 46 | | reporting period from a political contribution if the payment is |
---|
47 | 47 | | not a political expenditure, the full name and address of the person |
---|
48 | 48 | | to whom the payment is made, and the date and purpose of the |
---|
49 | 49 | | payment; |
---|
50 | 50 | | (5) the total amount or a specific listing of the |
---|
51 | 51 | | political contributions of $50 or less accepted and the total |
---|
52 | 52 | | amount or a specific listing of the political expenditures of $100 |
---|
53 | 53 | | or less made during the reporting period; |
---|
54 | 54 | | (6) the total amount of all political contributions |
---|
55 | 55 | | accepted and the total amount of all political expenditures made |
---|
56 | 56 | | during the reporting period; |
---|
57 | 57 | | (7) the name of each candidate or officeholder for |
---|
58 | 58 | | whom [who benefits from] a direct campaign expenditure was made to |
---|
59 | 59 | | support or oppose during the reporting period by the person or |
---|
60 | 60 | | committee required to file the report, and the office sought or |
---|
61 | 61 | | held, excluding a direct campaign expenditure that is made by the |
---|
62 | 62 | | principal political committee of a political party on behalf of a |
---|
63 | 63 | | slate of two or more nominees of that party; |
---|
64 | 64 | | (8) as of the last day of a reporting period for which |
---|
65 | 65 | | the person is required to file a report, the total amount of |
---|
66 | 66 | | political contributions accepted, including interest or other |
---|
67 | 67 | | income on those contributions, maintained in one or more accounts |
---|
68 | 68 | | in which political contributions are deposited as of the last day of |
---|
69 | 69 | | the reporting period; |
---|
70 | 70 | | (9) any credit, interest, rebate, refund, |
---|
71 | 71 | | reimbursement, or return of a deposit fee resulting from the use of |
---|
72 | 72 | | a political contribution or an asset purchased with a political |
---|
73 | 73 | | contribution that is received during the reporting period and the |
---|
74 | 74 | | amount of which exceeds $100; |
---|
75 | 75 | | (10) any proceeds of the sale of an asset purchased |
---|
76 | 76 | | with a political contribution that is received during the reporting |
---|
77 | 77 | | period and the amount of which exceeds $100; |
---|
78 | 78 | | (11) any investment purchased with a political |
---|
79 | 79 | | contribution that is received during the reporting period and the |
---|
80 | 80 | | amount of which exceeds $100; |
---|
81 | 81 | | (12) any other gain from a political contribution that |
---|
82 | 82 | | is received during the reporting period and the amount of which |
---|
83 | 83 | | exceeds $100; and |
---|
84 | 84 | | (13) the full name and address of each person from whom |
---|
85 | 85 | | an amount described by Subdivision (9), (10), (11), or (12) is |
---|
86 | 86 | | received, the date the amount is received, and the purpose for which |
---|
87 | 87 | | the amount is received. |
---|
88 | 88 | | SECTION 3. The changes in law made by this Act apply only to |
---|
89 | 89 | | a report under Chapter 254, Election Code, that is required to be |
---|
90 | 90 | | filed on or after the effective date of this Act. A report under |
---|
91 | 91 | | that chapter that is required to be filed before the effective date |
---|
92 | 92 | | of this Act is governed by the law in effect on the date the report |
---|
93 | 93 | | is required to be filed, and the former law is continued in effect |
---|
94 | 94 | | for that purpose. |
---|
95 | 95 | | SECTION 4. This Act takes effect September 1, 2025. |
