9 | 9 | | relating to Medicaid reimbursement rates for certain ground |

10 | 10 | | ambulance services. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 32.028, Human Resources Code, is amended |
---|
13 | 13 | | by adding Subsection (o) to read as follows: |
---|
14 | 14 | | (o) The executive commissioner shall ensure that the rules |
---|
15 | 15 | | governing the determination of medical assistance reimbursement |
---|
16 | 16 | | base rates paid to a provider for providing ground ambulance |
---|
17 | 17 | | services are at least equal to 40 percent of the rate paid under |
---|
18 | 18 | | Medicare for providing ground ambulance services originating in a |
---|
19 | 19 | | rural area. |
---|
20 | 20 | | SECTION 2. Subchapter F, Chapter 540, Government Code, as |
---|
21 | 21 | | effective April 1, 2025, is amended by adding Section 540.0281 to |
---|
22 | 22 | | read as follows: |
---|
23 | 23 | | Sec. 540.0281. REIMBURSEMENT RATE FOR CERTAIN GROUND |
---|
24 | 24 | | AMBULANCE SERVICE PROVIDERS. A contract to which this subchapter |
---|
25 | 25 | | applies must require the contracting Medicaid managed care |
---|
26 | 26 | | organization to: |
---|
27 | 27 | | (1) reimburse a provider who is in the organization's |
---|
28 | 28 | | provider network and who provides ground ambulance services at a |
---|
29 | 29 | | rate that is at least equal to the rate paid under Medicare for the |
---|
30 | 30 | | provision of ground ambulance services originating in a rural area; |
---|
31 | 31 | | and |
---|
32 | 32 | | (2) annually increase the reimbursement rate by three |
---|
33 | 33 | | percent. |
---|
34 | 34 | | SECTION 3. (a) The Health and Human Services Commission |
---|
35 | 35 | | shall, in a contract between the commission and a managed care |
---|
36 | 36 | | organization under Chapter 540, Government Code, as effective April |
---|
37 | 37 | | 1, 2025, that is entered into or renewed on or after the effective |
---|
38 | 38 | | date of this Act, require that the managed care organization comply |
---|
39 | 39 | | with Section 540.0281, Government Code, as added by this Act. |
---|
40 | 40 | | (b) The Health and Human Services Commission shall seek to |
---|
41 | 41 | | amend contracts entered into with managed care organizations before |
---|
42 | 42 | | the effective date of this Act to require those managed care |
---|
43 | 43 | | organizations to comply with Section 540.0281, Government Code, as |
---|
44 | 44 | | added by this Act. To the extent of a conflict between Section |
---|
45 | 45 | | 540.0281, Government Code, as added by this Act, and a provision of |
---|
46 | 46 | | a contract with a managed care organization entered into before the |
---|
47 | 47 | | effective date of this Act, the contract provision prevails. |
---|
48 | 48 | | SECTION 4. If before implementing any provision of this Act |
---|
49 | 49 | | a state agency determines that a waiver or authorization from a |
---|
50 | 50 | | federal agency is necessary for implementation of that provision, |
---|
51 | 51 | | the agency affected by the provision shall request the waiver or |
---|
52 | 52 | | authorization and may delay implementing that provision until the |
---|
53 | 53 | | waiver or authorization is granted. |
---|
54 | 54 | | SECTION 5. This Act takes effect September 1, 2025. |
