77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to Medicaid reimbursement rates for certain ground
1010 ambulance services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.028, Human Resources Code, is amended
1313 by adding Subsection (o) to read as follows:
1414 (o) The executive commissioner shall ensure that the rules
1515 governing the determination of medical assistance reimbursement
1616 base rates paid to a provider for providing ground ambulance
1717 services are at least equal to 40 percent of the rate paid under
1818 Medicare for providing ground ambulance services originating in a
1919 rural area.
2020 SECTION 2. Subchapter F, Chapter 540, Government Code, as
2121 effective April 1, 2025, is amended by adding Section 540.0281 to
2222 read as follows:
2323 Sec. 540.0281. REIMBURSEMENT RATE FOR CERTAIN GROUND
2424 AMBULANCE SERVICE PROVIDERS. A contract to which this subchapter
2525 applies must require the contracting Medicaid managed care
2626 organization to:
2727 (1) reimburse a provider who is in the organization's
2828 provider network and who provides ground ambulance services at a
2929 rate that is at least equal to the rate paid under Medicare for the
3030 provision of ground ambulance services originating in a rural area;
3131 and
3232 (2) annually increase the reimbursement rate by three
3333 percent.
3434 SECTION 3. (a) The Health and Human Services Commission
3535 shall, in a contract between the commission and a managed care
3636 organization under Chapter 540, Government Code, as effective April
3737 1, 2025, that is entered into or renewed on or after the effective
3838 date of this Act, require that the managed care organization comply
3939 with Section 540.0281, Government Code, as added by this Act.
4040 (b) The Health and Human Services Commission shall seek to
4141 amend contracts entered into with managed care organizations before
4242 the effective date of this Act to require those managed care
4343 organizations to comply with Section 540.0281, Government Code, as
4444 added by this Act. To the extent of a conflict between Section
4545 540.0281, Government Code, as added by this Act, and a provision of
4646 a contract with a managed care organization entered into before the
4747 effective date of this Act, the contract provision prevails.
4848 SECTION 4. If before implementing any provision of this Act
4949 a state agency determines that a waiver or authorization from a
5050 federal agency is necessary for implementation of that provision,
5151 the agency affected by the provision shall request the waiver or
5252 authorization and may delay implementing that provision until the
5353 waiver or authorization is granted.
5454 SECTION 5. This Act takes effect September 1, 2025.
