77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to mass balance attribution of renewable biomass
1010 feedstocks used to produce renewable chemicals.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 361.421, Health and Safety Code, is
1313 amended by adding Subdivisions (8-a) and (8-b) to read as follows:
1414 (8-a) "Renewable biomass" means:
1515 (A) materials, pre-commercial thinnings, or
1616 invasive species from National Forest System land and public lands,
1717 as that term is defined by 43 U.S.C. Section 1702, that:
1818 (i) are byproducts of preventive treatments
1919 that are removed:
2020 (a) to reduce hazardous fuels;
2121 (b) to reduce or contain disease or
2222 insect infestation; or
2323 (c) to restore ecosystem health;
2424 (ii) would not otherwise be used for higher
2525 value products; and
2626 (iii) are harvested in accordance with:
2727 (a) applicable law and land
2828 management plans; and
2929 (b) requirements for old growth stand
3030 maintenance, restoration, and management direction and large tree
3131 retention under Sections 102(e) and (f), Healthy Forests
3232 Restoration Act of 2003 (16 U.S.C. Sections 6512(e) and (f)); or
3333 (B) any organic matter that is available on a
3434 renewable or recurring basis from nonfederal land or land belonging
3535 to an Indian or Indian tribe that is held in trust by the United
3636 States or subject to a restriction against alienation imposed by
3737 the United States, including:
3838 (i) renewable plant material, including:
3939 (a) feed grains and other
4040 agricultural commodities;
4141 (b) plants and trees; and
4242 (c) algae; and
4343 (ii) waste material, including:
4444 (a) crop residue;
4545 (b) vegetative waste material,
4646 including wood waste and wood residue;
4747 (c) animal waste and byproducts,
4848 including fats, oils, greases, and manure; and
4949 (d) food waste and yard waste.
5050 (8-b) "Renewable chemical" means a monomer, polymer,
5151 plastic, formulated product, or chemical substance produced from
5252 renewable biomass feedstocks or certified under a third-party
5353 certification system for mass balance attribution identified by the
5454 commission under Section 361.4215.
5555 SECTION 2. Section 361.4215, Health and Safety Code, is
5656 amended to read as follows:
5757 Sec. 361.4215. MASS BALANCE ATTRIBUTION. The commission by
5858 rule shall identify third-party certification systems for mass
5959 balance attribution that may be used for the purposes of Sections
6060 361.421(6), [and] (6-a), and (8-b).
6161 SECTION 3. As soon as practicable after the effective date
6262 of this Act, the Texas Commission on Environmental Quality shall
6363 adopt rules necessary to implement the changes in law made by this
6464 Act.
6565 SECTION 4. This Act takes effect September 1, 2025.
