| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 451.0025, Labor Code, is |

| 13 | 13 | | amended to read as follows: |

| 14 | 14 | | Sec. 451.0025. WAIVER OF IMMUNITY; PERMISSION [FOR FIRST |

| 16 | 16 | | SECTION 2. Sections 451.0025(a) and (b), Labor Code, are |

| 17 | 17 | | amended to read as follows: |

| 19 | 19 | | (1) "First[, "first] responder" has the meaning |
|---|
| 20 | 20 | | assigned by Section 421.095, Government Code. |

| 21 | 21 | | (2) "Local governmental entity," "public employee," |
|---|
| 22 | 22 | | and "state governmental entity" have the meanings assigned by |
|---|
| 23 | 23 | | Section 554.001, Government Code. |
|---|
| 24 | 24 | | (b) A first responder or public employee who alleges a |
|---|
| 25 | 25 | | violation of Section 451.001 by a state or local governmental |
|---|
| 26 | 26 | | entity that employs the first responder or employee may sue the |
|---|
| 27 | 27 | | governmental entity for the relief provided by this chapter. |
|---|
| 28 | 28 | | Sovereign or governmental immunity from suit is waived and |
|---|
| 29 | 29 | | abolished to the extent of liability created by this chapter. |
|---|
| 30 | 30 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to a cause of action that accrues on or after the effective date of |
|---|
| 32 | 32 | | this Act. |

| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2025. |
