88 AN ACT
99 relating to waiver of immunity in certain employment discrimination
1010 actions in connection with a workers' compensation claim.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 451.0025, Labor Code, is
1313 amended to read as follows:
1414 Sec. 451.0025. WAIVER OF IMMUNITY; PERMISSION [FOR FIRST
1515 RESPONDER] TO SUE.
1616 SECTION 2. Sections 451.0025(a) and (b), Labor Code, are
1717 amended to read as follows:
1818 (a) In this section:
1919 (1) "First[, "first] responder" has the meaning
2020 assigned by Section 421.095, Government Code.
2121 (2) "Local governmental entity," "public employee,"
2222 and "state governmental entity" have the meanings assigned by
2323 Section 554.001, Government Code.
2424 (b) A first responder or public employee who alleges a
2525 violation of Section 451.001 by a state or local governmental
2626 entity that employs the first responder or employee may sue the
2727 governmental entity for the relief provided by this chapter.
2828 Sovereign or governmental immunity from suit is waived and
2929 abolished to the extent of liability created by this chapter.
3030 SECTION 3. The change in law made by this Act applies only
3131 to a cause of action that accrues on or after the effective date of
3232 this Act.
3333 SECTION 4. This Act takes effect September 1, 2025.
