77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the collection of information on available beds at
1010 inpatient mental health facilities providing acute psychiatric
1111 treatment.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 311.0335(a), Health and Safety Code, is
1414 amended to read as follows:
1515 (a) A hospital that provides mental health or chemical
1616 dependency services shall submit to the department financial and
1717 utilization data relating to the mental health and chemical
1818 dependency services provided by the hospital, including data for
1919 inpatient and outpatient services relating to:
2020 (1) patient demographics, including race, ethnicity,
2121 age, gender, and county of residence;
2222 (2) admissions;
2323 (3) discharges, including length of inpatient
2424 treatment;
2525 (4) specific diagnoses and procedures according to
2626 criteria prescribed by the Diagnostic and Statistical Manual of
2727 Mental Disorders, 3rd Edition, Revised, or a later version
2828 prescribed by department rule;
2929 (5) total charges and the components of the charges;
3030 (6) payor sources; [and]
3131 (7) use of mechanical restraints; and
3232 (8) availability of inpatient psychiatric beds by age.
3333 SECTION 2. (a) In this section:
3434 (1) "Commission" means the Health and Human Services
3535 Commission.
3636 (2) "Inpatient mental health facility" has the meaning
3737 assigned by Section 571.003, Health and Safety Code.
3838 (b) The commission shall conduct a study regarding the
3939 availability of beds at inpatient mental health facilities in this
4040 state that provide acute inpatient psychiatric treatment. The
4141 study must evaluate:
4242 (1) the current number of psychiatric beds available
4343 at inpatient mental health facilities in this state that provide
4444 inpatient psychiatric treatment to individuals experiencing an
4545 acute mental health crisis, including a breakdown of beds
4646 available:
4747 (A) at inpatient mental health facilities that
4848 are state hospitals operated by the Department of State Health
4949 Services;
5050 (B) at inpatient mental health facilities other
5151 than facilities operated by the Department of State Health
5252 Services; and
5353 (C) for patients:
5454 (i) committed to a facility for competency
5555 restoration services under Chapter 46B, Code of Criminal Procedure;
5656 (ii) civilly committed to a facility under
5757 Chapter 841, Health and Safety Code;
5858 (iii) committed to a facility after having
5959 been found not guilty by reason of insanity under Chapter 46C, Code
6060 of Criminal Procedure;
6161 (iv) voluntarily admitted to a facility;
6262 (v) 18 years of age or older;
6363 (vi) 12 years of age or older but younger
6464 than 18 years of age;
6565 (vii) 11 years of age or younger;
6666 (viii) receiving long-term mental health
6767 treatment in a facility; and
6868 (ix) who have been diagnosed with an
6969 intellectual or developmental disability;
7070 (2) the current number of patients admitted to an
7171 inpatient mental health facility in this state that provides
7272 inpatient psychiatric treatment to individuals experiencing an
7373 acute mental health crisis, including a breakdown of:
7474 (A) the number of patients committed to a
7575 facility for competency restoration services under Chapter 46B,
7676 Code of Criminal Procedure, including the number of individuals
7777 committed under an initial order of commitment or an order
7878 extending the initial restoration period;
7979 (B) the number of patients civilly committed to a
8080 facility under Chapter 841, Health and Safety Code;
8181 (C) the number of patients committed to a
8282 facility after having been found not guilty by reason of insanity
8383 under Chapter 46C, Code of Criminal Procedure;
8484 (D) the number of patients voluntarily admitted
8585 to a facility;
8686 (E) the number of patients 18 years of age or
8787 older;
8888 (F) the number of patients 12 years of age or
8989 older but younger than 18 years of age;
9090 (G) the number of patients 11 years of age or
9191 younger;
9292 (H) the percentage of patients in this state who
9393 will likely require long-term mental health treatment in a
9494 facility;
9595 (I) the number of patients who have been
9696 diagnosed with an intellectual or developmental disability; and
9797 (J) the number of patients receiving services
9898 from a jail diversion program;
9999 (3) the projected need over the next several years for
100100 additional psychiatric beds at inpatient mental health facilities
101101 that provide inpatient psychiatric treatment to individuals
102102 experiencing an acute mental health crisis, including the projected
103103 percentage of incoming patients who will likely require long-term
104104 mental health treatment in a facility; and
105105 (4) current and anticipated resources, including
106106 workforce needs, necessary to meet the demands described by
107107 Subdivisions (1), (2), and (3) of this subsection.
108108 (c) In designing and conducting the study, the commission:
109109 (1) may collaborate with institutions of higher
110110 education, as defined by Section 61.003, Education Code, in this
111111 state that award medical degrees; and
112112 (2) shall collect the information required under
113113 Subsection (b) of this section at least twice.
114114 (d) Not later than September 1, 2026, the commission shall
115115 prepare and submit to the legislature a written report containing
116116 the results of the study and any recommendations for legislative or
117117 other action.
118118 (e) This section expires September 1, 2027.
119119 SECTION 3. This Act takes effect immediately if it receives
120120 a vote of two-thirds of all the members elected to each house, as
121121 provided by Section 39, Article III, Texas Constitution. If this
122122 Act does not receive the vote necessary for immediate effect, this
123123 Act takes effect September 1, 2025.
