77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to available resources of certain state agencies to
1010 support and sustain peer-recovery organizations in this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 547, Government Code, as effective April
1313 1, 2025, is amended by adding Subchapter J to read as follows:
1414 SUBCHAPTER J. PEER-RECOVERY ORGANIZATIONS
1515 Sec. 547.0451. DEFINITIONS. In this subchapter:
1616 (1) "Mental health condition" means a condition, other
1717 than a single diagnosis of an intellectual or developmental
1818 disability or a substance use disorder, that substantially impairs
1919 an individual's:
2020 (A) thoughts, perception of reality, emotional
2121 process, or judgment;
2222 (B) behavior; or
2323 (C) ability to participate in daily routines.
2424 (2) "Peer-recovery organization" means a nonprofit
2525 organization that:
2626 (A) is wholly or partly operated and governed by
2727 members of the community, with at least 51 percent of those members
2828 identifying as persons recovering from a substance use disorder or
2929 lived experience with a mental health condition;
3030 (B) mobilizes resources from inside and outside
3131 of a community to increase the prevalence and quality of recovery
3232 services for persons with mental health conditions or substance use
3333 disorders and their affected family members; and
3434 (C) delivers peer support services provided by
3535 persons recovering from a substance use disorder or lived
3636 experience with a mental health condition.
3737 (3) "Substance use disorder" means the recurrent use
3838 of alcohol or drugs that causes significant clinical and functional
3939 impairment, such as health problems, disability, and failure to
4040 complete major responsibilities at work, school, or home.
4141 Sec. 547.0452. ASSISTANCE FROM CERTAIN STATE AGENCIES. The
4242 following state agencies shall identify available resources,
4343 including funding, training, or technical assistance, to support
4444 and sustain peer-recovery organizations in this state:
4545 (1) the Health and Human Services Commission;
4646 (2) the Department of State Health Services;
4747 (3) the Department of Family and Protective Services;
4848 (4) the Texas Department of Housing and Community
4949 Affairs;
5050 (5) the Texas Department of Criminal Justice;
5151 (6) the Texas Juvenile Justice Department; and
5252 (7) the Texas Veterans Commission.
5353 Sec. 547.0453. BIENNIAL REPORT. Not later than August 1 of
5454 each even-numbered year, each state agency listed in Section
5555 547.0452 shall prepare and submit a written report to the
5656 legislature describing and detailing the state agency's available
5757 resources to support and sustain peer-recovery organizations in
5858 this state.
5959 SECTION 2. This Act takes effect September 1, 2025.
