10 | 10 | | support and sustain peer-recovery organizations in this state. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 547, Government Code, as effective April |
---|
13 | 13 | | 1, 2025, is amended by adding Subchapter J to read as follows: |
---|
14 | 14 | | SUBCHAPTER J. PEER-RECOVERY ORGANIZATIONS |
---|
15 | 15 | | Sec. 547.0451. DEFINITIONS. In this subchapter: |
---|
16 | 16 | | (1) "Mental health condition" means a condition, other |
---|
17 | 17 | | than a single diagnosis of an intellectual or developmental |
---|
18 | 18 | | disability or a substance use disorder, that substantially impairs |
---|
19 | 19 | | an individual's: |
---|
20 | 20 | | (A) thoughts, perception of reality, emotional |
---|
21 | 21 | | process, or judgment; |
---|
22 | 22 | | (B) behavior; or |
---|
23 | 23 | | (C) ability to participate in daily routines. |
---|
24 | 24 | | (2) "Peer-recovery organization" means a nonprofit |
---|
25 | 25 | | organization that: |
---|
26 | 26 | | (A) is wholly or partly operated and governed by |
---|
27 | 27 | | members of the community, with at least 51 percent of those members |
---|
28 | 28 | | identifying as persons recovering from a substance use disorder or |
---|
29 | 29 | | lived experience with a mental health condition; |
---|
30 | 30 | | (B) mobilizes resources from inside and outside |
---|
31 | 31 | | of a community to increase the prevalence and quality of recovery |
---|
32 | 32 | | services for persons with mental health conditions or substance use |
---|
33 | 33 | | disorders and their affected family members; and |
---|
34 | 34 | | (C) delivers peer support services provided by |
---|
35 | 35 | | persons recovering from a substance use disorder or lived |
---|
36 | 36 | | experience with a mental health condition. |
---|
37 | 37 | | (3) "Substance use disorder" means the recurrent use |
---|
38 | 38 | | of alcohol or drugs that causes significant clinical and functional |
---|
39 | 39 | | impairment, such as health problems, disability, and failure to |
---|
40 | 40 | | complete major responsibilities at work, school, or home. |
---|
41 | 41 | | Sec. 547.0452. ASSISTANCE FROM CERTAIN STATE AGENCIES. The |
---|
42 | 42 | | following state agencies shall identify available resources, |
---|
43 | 43 | | including funding, training, or technical assistance, to support |
---|
44 | 44 | | and sustain peer-recovery organizations in this state: |
---|
45 | 45 | | (1) the Health and Human Services Commission; |
---|
46 | 46 | | (2) the Department of State Health Services; |
---|
47 | 47 | | (3) the Department of Family and Protective Services; |
---|
48 | 48 | | (4) the Texas Department of Housing and Community |
---|
49 | 49 | | Affairs; |
---|
50 | 50 | | (5) the Texas Department of Criminal Justice; |
---|
51 | 51 | | (6) the Texas Juvenile Justice Department; and |
---|
52 | 52 | | (7) the Texas Veterans Commission. |
---|
53 | 53 | | Sec. 547.0453. BIENNIAL REPORT. Not later than August 1 of |
---|
54 | 54 | | each even-numbered year, each state agency listed in Section |
---|
55 | 55 | | 547.0452 shall prepare and submit a written report to the |
---|
56 | 56 | | legislature describing and detailing the state agency's available |
---|
57 | 57 | | resources to support and sustain peer-recovery organizations in |
---|
58 | 58 | | this state. |
---|
59 | 59 | | SECTION 2. This Act takes effect September 1, 2025. |
