77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the sale of alcoholic beverages in areas annexed by
1010 certain municipalities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 251.72, Alcoholic Beverage Code, is
1313 amended to read as follows:
1414 Sec. 251.72. CHANGE OF STATUS. Except as provided in
1515 Sections 251.725, 251.726, 251.727, 251.728, 251.73, and 251.80, an
1616 authorized voting unit that has exercised or may exercise the right
1717 of local option retains the status adopted, whether absolute
1818 prohibition or legalization of the sale of alcoholic beverages of
1919 one or more of the various types and alcoholic contents on which an
2020 issue may be submitted under the terms of Section 501.035, Election
2121 Code, until that status is changed by a subsequent local option
2222 election in the same authorized voting unit.
2323 SECTION 2. Subchapter D, Chapter 251, Alcoholic Beverage
2424 Code, is amended by adding Section 251.728 to read as follows:
2525 Sec. 251.728. CHANGE OF STATUS FOR TERRITORY ANNEXED OR
2626 OWNED BY MUNICIPALITIES IN CERTAIN COUNTIES. (a) This section
2727 applies only to a municipality that:
2828 (1) is wholly located in a county containing a portion
2929 of U.S. Highways 60 and 87; and
3030 (2) has a population of more than 12,000.
3131 (b) Notwithstanding any other law, an area annexed to a
3232 municipality to which this section applies assumes the wet or dry
3333 status of that municipality.
3434 SECTION 3. The change in law made by this Act applies to an
3535 area annexed by a municipality before, on, or after the effective
3636 date of this Act.
3737 SECTION 4. This Act takes effect September 1, 2025.
