| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subtitle H, Title 2, Health and Safety Code, is |
|---|
| 13 | 13 | | amended by adding Chapter 180 to read as follows: |
|---|
| 14 | 14 | | CHAPTER 180. HEALTH CARE PROVIDER USE OF ARTIFICIAL INTELLIGENCE |
|---|
| 15 | 15 | | Sec. 180.001. DEFINITIONS. In this chapter: |
|---|
| 16 | 16 | | (1) "Artificial intelligence" means computer software |
|---|
| 17 | 17 | | designed to simulate human intelligence through machine learning |
|---|
| 18 | 18 | | and perform tasks normally requiring human involvement. |
|---|
| 19 | 19 | | (2) "Health care provider" means an individual who is |
|---|
| 20 | 20 | | licensed, certified, or otherwise authorized to provide health care |
|---|
| 21 | 21 | | services in this state. |
|---|
| 22 | 22 | | Sec. 180.002. RULES GOVERNING HEALTH CARE PROVIDER USE OF |
|---|
| 23 | 23 | | ARTIFICIAL INTELLIGENCE. (a) The executive commissioner by rule |
|---|
| 24 | 24 | | shall regulate the use of artificial intelligence by health care |
|---|
| 25 | 25 | | providers in this state. |
|---|
| 26 | 26 | | (b) The rules adopted under Subsection (a) must: |
|---|
| 27 | 27 | | (1) address the procedures necessary for a health care |
|---|
| 28 | 28 | | provider to responsibly use artificial intelligence in the |
|---|
| 29 | 29 | | provision of health care services and in analyzing and |
|---|
| 30 | 30 | | understanding health care information; and |
|---|
| 31 | 31 | | (2) require a health care provider using artificial |
|---|
| 32 | 32 | | intelligence in the provision of health care services to use an |
|---|
| 33 | 33 | | automated messaging system when sending a message to the provider's |
|---|
| 34 | 34 | | patients that: |
|---|
| 35 | 35 | | (A) discloses the health care provider uses |
|---|
| 36 | 36 | | artificial intelligence in the provision of health care services; |
|---|
| 37 | 37 | | and |
|---|
| 38 | 38 | | (B) provides patients with contact information |
|---|
| 39 | 39 | | of a health care provider who is available to answer questions or |
|---|
| 40 | 40 | | address concerns. |
|---|
| 41 | 41 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 42 | 42 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 43 | 43 | | Services Commission shall adopt the rules required by Chapter 180, |
|---|
| 44 | 44 | | Health and Safety Code, as added by this Act. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2025. |
