88 AN ACT
99 relating to the use of artificial intelligence by health care
1010 providers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle H, Title 2, Health and Safety Code, is
1313 amended by adding Chapter 180 to read as follows:
1414 CHAPTER 180. HEALTH CARE PROVIDER USE OF ARTIFICIAL INTELLIGENCE
1515 Sec. 180.001. DEFINITIONS. In this chapter:
1616 (1) "Artificial intelligence" means computer software
1717 designed to simulate human intelligence through machine learning
1818 and perform tasks normally requiring human involvement.
1919 (2) "Health care provider" means an individual who is
2020 licensed, certified, or otherwise authorized to provide health care
2121 services in this state.
2222 Sec. 180.002. RULES GOVERNING HEALTH CARE PROVIDER USE OF
2323 ARTIFICIAL INTELLIGENCE. (a) The executive commissioner by rule
2424 shall regulate the use of artificial intelligence by health care
2525 providers in this state.
2626 (b) The rules adopted under Subsection (a) must:
2727 (1) address the procedures necessary for a health care
2828 provider to responsibly use artificial intelligence in the
2929 provision of health care services and in analyzing and
3030 understanding health care information; and
3131 (2) require a health care provider using artificial
3232 intelligence in the provision of health care services to use an
3333 automated messaging system when sending a message to the provider's
3434 patients that:
3535 (A) discloses the health care provider uses
3636 artificial intelligence in the provision of health care services;
3737 and
3838 (B) provides patients with contact information
3939 of a health care provider who is available to answer questions or
4040 address concerns.
4141 SECTION 2. As soon as practicable after the effective date
4242 of this Act, the executive commissioner of the Health and Human
4343 Services Commission shall adopt the rules required by Chapter 180,
4444 Health and Safety Code, as added by this Act.
4545 SECTION 3. This Act takes effect September 1, 2025.
