9 | 9 | | relating to the projects eligible for financial assistance from the |

10 | 10 | | flood infrastructure fund. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 15.531(2), Water Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (2) "Flood project" means a drainage, flood |
---|
15 | 15 | | mitigation, or flood control project, including: |
---|
16 | 16 | | (A) planning and design activities; |
---|
17 | 17 | | (B) work to obtain regulatory approval to provide |
---|
18 | 18 | | nonstructural and structural flood mitigation and drainage; |
---|
19 | 19 | | (C) construction of structural flood mitigation |
---|
20 | 20 | | and drainage infrastructure; [and] |
---|
21 | 21 | | (D) construction and implementation of |
---|
22 | 22 | | nonstructural projects, including projects that use nature-based |
---|
23 | 23 | | features to protect, mitigate, or reduce flood risk; and |
---|
24 | 24 | | (E) construction of multi-purpose flood |
---|
25 | 25 | | mitigation and drainage infrastructure projects that control, |
---|
26 | 26 | | divert, capture, or impound floodwater, stormwater, agricultural |
---|
27 | 27 | | runoff water, or treated wastewater effluent and treat and |
---|
28 | 28 | | distribute the water for the purpose of creating an additional |
---|
29 | 29 | | source of water supply. |

30 | 30 | | SECTION 2. This Act takes effect September 1, 2025. |
