88 AN ACT
99 relating to authorizing certain counties to contract for outside
1010 legal counsel in certain situations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subchapter D, Chapter 2254,
1313 Government Code, is amended to read as follows:
1414 SUBCHAPTER D. OUTSIDE LEGAL SERVICES FOR STATE AGENCIES AND CERTAIN
1515 COUNTIES
1616 SECTION 2. Section 2254.152, Government Code, is amended to
1717 read as follows:
1818 Sec. 2254.152. APPLICABILITY. (a) This subchapter applies
1919 only to:
2020 (1) a state agency; and
2121 (2) a county that has a population of more than 3.3
2222 million.
2323 (b) This subchapter does not apply to a contingent fee
2424 contract for legal services.
2525 SECTION 3. The heading to Section 2254.153, Government
2626 Code, is amended to read as follows:
2727 Sec. 2254.153. CONTRACTS FOR LEGAL SERVICES FOR STATE
2828 AGENCIES AUTHORIZED.
2929 SECTION 4. The heading to Section 2254.154, Government
3030 Code, is amended to read as follows:
3131 Sec. 2254.154. ATTORNEY GENERAL REQUIREMENT
3232 FOR[;] COMPETITIVE PROCUREMENT FOR STATE AGENCIES.
3333 SECTION 5. Subchapter D, Chapter 2254, Government Code, is
3434 amended by adding Section 2254.155 to read as follows:
3535 Sec. 2254.155. CONTRACTS FOR LEGAL SERVICES FOR CERTAIN
3636 COUNTIES AUTHORIZED IN CERTAIN SITUATIONS. (a) Notwithstanding
3737 any other law, the commissioners court of a county may contract for
3838 outside legal services from counsel selected by a county official
3939 if the official or the official's staff are subject to a civil
4040 action or otherwise require legal counsel related to the discharge
4141 of official duties in a situation in which the official reasonably
4242 believes the county attorney may have a conflict of interest.
4343 (b) Outside legal counsel providing services under this
4444 section may not settle or compromise any action against a county
4545 official or the official's staff without the approval of the
4646 official and the commissioners court of the county.
4747 (c) The commissioners court of the county shall authorize
4848 payment for legal services provided by outside legal counsel under
4949 Subsection (b). Any payments authorized by the commissioners court
5050 for outside legal services are subject to audit by the county
5151 auditor.
5252 (d) Notwithstanding any other law, the county attorney may
5353 not provide legal services related to a contract entered into under
5454 this section.
5555 SECTION 6. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2025.
