77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the unlawful production or distribution of sexually
1010 explicit images using deep fake technology.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 21.165, Penal Code, is
1313 amended to read as follows:
1414 Sec. 21.165. UNLAWFUL PRODUCTION OR DISTRIBUTION OF CERTAIN
1515 SEXUALLY EXPLICIT IMAGES OR VIDEOS.
1616 SECTION 2. Section 21.165(a), Penal Code, is amended by
1717 amending Subdivision (1) and adding Subdivision (1-a) to read as
1818 follows:
1919 (1) "Deep fake image" means an image, created with the
2020 intent to deceive, that appears to depict a real person performing
2121 an action that did not occur in reality.
2222 (1-a) "Deep fake video" means a video, created with
2323 the intent to deceive, that appears to depict a real person
2424 performing an action that did not occur in reality.
2525 SECTION 3. Section 21.165(b), Penal Code, is amended to
2626 read as follows:
2727 (b) A person commits an offense if, without the effective
2828 consent of the person appearing to be depicted, the person
2929 knowingly produces or distributes by electronic means a deep fake
3030 image or deep fake video that appears to depict the person with the
3131 person's intimate parts exposed or engaged in sexual conduct.
3232 SECTION 4. The change in law made by this Act applies only
3333 to an offense committed on or after the effective date of this Act.
3434 An offense committed before the effective date of this Act is
3535 governed by the law in effect on the date the offense was committed,
3636 and the former law is continued in effect for that purpose. For
3737 purposes of this section, an offense was committed before the
3838 effective date of this Act if any element of the offense occurred
3939 before that date.
4040 SECTION 5. This Act takes effect September 1, 2025.
