| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 21.165, Penal Code, is |

| 13 | 13 | | amended to read as follows: |

| 14 | 14 | | Sec. 21.165. UNLAWFUL PRODUCTION OR DISTRIBUTION OF CERTAIN |

| 15 | 15 | | SEXUALLY EXPLICIT IMAGES OR VIDEOS. |

| 16 | 16 | | SECTION 2. Section 21.165(a), Penal Code, is amended by |

| 17 | 17 | | amending Subdivision (1) and adding Subdivision (1-a) to read as |
|---|
| 18 | 18 | | follows: |

| 19 | 19 | | (1) "Deep fake image" means an image, created with the |
|---|
| 20 | 20 | | intent to deceive, that appears to depict a real person performing |
|---|
| 21 | 21 | | an action that did not occur in reality. |

| 22 | 22 | | (1-a) "Deep fake video" means a video, created with |
|---|
| 23 | 23 | | the intent to deceive, that appears to depict a real person |
|---|
| 24 | 24 | | performing an action that did not occur in reality. |

| 25 | 25 | | SECTION 3. Section 21.165(b), Penal Code, is amended to |
|---|
| 26 | 26 | | read as follows: |
|---|
| 27 | 27 | | (b) A person commits an offense if, without the effective |
|---|
| 28 | 28 | | consent of the person appearing to be depicted, the person |
|---|
| 29 | 29 | | knowingly produces or distributes by electronic means a deep fake |
|---|
| 30 | 30 | | image or deep fake video that appears to depict the person with the |
|---|
| 31 | 31 | | person's intimate parts exposed or engaged in sexual conduct. |
|---|
| 32 | 32 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 33 | 33 | | to an offense committed on or after the effective date of this Act. |
|---|
| 34 | 34 | | An offense committed before the effective date of this Act is |
|---|
| 35 | 35 | | governed by the law in effect on the date the offense was committed, |
|---|
| 36 | 36 | | and the former law is continued in effect for that purpose. For |
|---|
| 37 | 37 | | purposes of this section, an offense was committed before the |
|---|
| 38 | 38 | | effective date of this Act if any element of the offense occurred |
|---|
| 39 | 39 | | before that date. |
|---|
| 40 | 40 | | SECTION 5. This Act takes effect September 1, 2025. |
