| 20 | 20 | | Code, is amended by adding Section 232.0011 to read as follows: |

| 21 | 21 | | Sec. 232.0011. AUTHORITY TO REGULATE RESIDENTIAL |
|---|
| 22 | 22 | | DEVELOPMENT. (a) In this section, "residential development" means |
|---|
| 23 | 23 | | land developed for dwelling use. The term includes rental units, |
|---|
| 24 | 24 | | apartments, recreational vehicle parks, and trailer parks. |
|---|
| 25 | 25 | | (b) For purposes of this subchapter, a county may regulate a |
|---|
| 26 | 26 | | residential development in the same manner as a subdivision. |
|---|
| 27 | 27 | | SECTION 4. Section 232.007, Local Government Code, is |
|---|
| 28 | 28 | | repealed. |
|---|
| 29 | 29 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2025. |
