8 | 8 | | relating to the compensation, reimbursement of expenses, and |

9 | 9 | | retirement benefits of a member of the State Board of Education. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 7.105, Education Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | Sec. 7.105. COMPENSATION AND REIMBURSEMENT. [(a)] A |
---|
14 | 14 | | member of the board is [not] entitled to receive compensation and |
---|
15 | 15 | | reimbursement of the member's expenses in the same amount and |
---|
16 | 16 | | manner as a member of the legislature as provided by Section 24, |
---|
17 | 17 | | Article III, Texas Constitution. |
---|
18 | 18 | | [(b) A member of the board is entitled to reimbursement of |
---|
19 | 19 | | the member's expenses as provided by law.] |
---|
20 | 20 | | SECTION 2. Section 810.003(b), Government Code, is amended |
---|
21 | 21 | | to read as follows: |
---|
22 | 22 | | (b) This section applies only to a person who is: |
---|
23 | 23 | | (1) a member of the elected class of the Employees |
---|
24 | 24 | | Retirement System of Texas as described by Section 812.002(a)(1), |
---|
25 | 25 | | [or] (2), or (4); or |
---|
26 | 26 | | (2) otherwise eligible for membership in a public |
---|
27 | 27 | | retirement system wholly or partly because the person was elected |
---|
28 | 28 | | or appointed to an elected office. |
---|
29 | 29 | | SECTION 3. Section 812.002(a), Government Code, is amended |
---|
30 | 30 | | to read as follows: |
---|
31 | 31 | | (a) Membership in the elected class of the retirement system |
---|
32 | 32 | | is limited to: |
---|
33 | 33 | | (1) persons who hold state offices that are normally |
---|
34 | 34 | | filled by statewide election and that are not included in the |
---|
35 | 35 | | coverage of the Judicial Retirement System of Texas Plan One or the |
---|
36 | 36 | | Judicial Retirement System of Texas Plan Two; |
---|
37 | 37 | | (2) members of the legislature; [and] |
---|
38 | 38 | | (3) district and criminal district attorneys, to the |
---|
39 | 39 | | extent that they receive salaries from the state general revenue |
---|
40 | 40 | | fund; and |
---|
41 | 41 | | (4) members of the State Board of Education. |
---|
42 | 42 | | SECTION 4. Section 820.053(c), Government Code, is amended |
---|
43 | 43 | | to read as follows: |
---|
44 | 44 | | (c) For purposes of this section, a member of the elected |
---|
45 | 45 | | class of membership under Section 812.002(a)(2) or (4) shall have |
---|
46 | 46 | | the member's accumulated account balance computed as if the |
---|
47 | 47 | | contributions to the account were based on the state base salary, |
---|
48 | 48 | | excluding longevity pay payable under Section 659.0445, being paid |
---|
49 | 49 | | a district judge as set by the General Appropriations Act in |
---|
50 | 50 | | accordance with Section 659.012(a). |
---|
51 | 51 | | SECTION 5. (a) In this section, "retirement system" means |
---|
52 | 52 | | the Employees Retirement System of Texas. |
---|
53 | 53 | | (b) For purposes of Subtitle B, Title 8, Government Code, as |
---|
54 | 54 | | amended by this Act, including Section 820.002, Government Code: |
---|
55 | 55 | | (1) the date a person described by Section |
---|
56 | 56 | | 812.002(a)(4), Government Code, as added by this Act, took office |
---|
57 | 57 | | is considered to be September 1, 2025; and |
---|
58 | 58 | | (2) only service performed by that person on or after |
---|
59 | 59 | | that date is creditable in the retirement system. |
---|
60 | 60 | | (c) For purposes of administering the changes in law made by |
---|
61 | 61 | | this Act to Subtitle B, Title 8, Government Code, the retirement |
---|
62 | 62 | | system, the State Board of Education, and, if necessary as |
---|
63 | 63 | | determined by the retirement system, the Texas Education Agency, |
---|
64 | 64 | | shall enter into a memorandum of understanding on the collection of |
---|
65 | 65 | | member contributions and other matters the retirement system |
---|
66 | 66 | | considers advisable. |
---|
67 | 67 | | (d) The retirement system may adopt rules to implement |
---|
68 | 68 | | Subtitle B, Title 8, Government Code, as amended by this Act. |
---|
69 | 69 | | SECTION 6. This Act takes effect September 1, 2025. |
