66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the compensation, reimbursement of expenses, and
99 retirement benefits of a member of the State Board of Education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 7.105, Education Code, is amended to
1212 read as follows:
1313 Sec. 7.105. COMPENSATION AND REIMBURSEMENT. [(a)] A
1414 member of the board is [not] entitled to receive compensation and
1515 reimbursement of the member's expenses in the same amount and
1616 manner as a member of the legislature as provided by Section 24,
1717 Article III, Texas Constitution.
1818 [(b) A member of the board is entitled to reimbursement of
1919 the member's expenses as provided by law.]
2020 SECTION 2. Section 810.003(b), Government Code, is amended
2121 to read as follows:
2222 (b) This section applies only to a person who is:
2323 (1) a member of the elected class of the Employees
2424 Retirement System of Texas as described by Section 812.002(a)(1),
2525 [or] (2), or (4); or
2626 (2) otherwise eligible for membership in a public
2727 retirement system wholly or partly because the person was elected
2828 or appointed to an elected office.
2929 SECTION 3. Section 812.002(a), Government Code, is amended
3030 to read as follows:
3131 (a) Membership in the elected class of the retirement system
3232 is limited to:
3333 (1) persons who hold state offices that are normally
3434 filled by statewide election and that are not included in the
3535 coverage of the Judicial Retirement System of Texas Plan One or the
3636 Judicial Retirement System of Texas Plan Two;
3737 (2) members of the legislature; [and]
3838 (3) district and criminal district attorneys, to the
3939 extent that they receive salaries from the state general revenue
4040 fund; and
4141 (4) members of the State Board of Education.
4242 SECTION 4. Section 820.053(c), Government Code, is amended
4343 to read as follows:
4444 (c) For purposes of this section, a member of the elected
4545 class of membership under Section 812.002(a)(2) or (4) shall have
4646 the member's accumulated account balance computed as if the
4747 contributions to the account were based on the state base salary,
4848 excluding longevity pay payable under Section 659.0445, being paid
4949 a district judge as set by the General Appropriations Act in
5050 accordance with Section 659.012(a).
5151 SECTION 5. (a) In this section, "retirement system" means
5252 the Employees Retirement System of Texas.
5353 (b) For purposes of Subtitle B, Title 8, Government Code, as
5454 amended by this Act, including Section 820.002, Government Code:
5555 (1) the date a person described by Section
5656 812.002(a)(4), Government Code, as added by this Act, took office
5757 is considered to be September 1, 2025; and
5858 (2) only service performed by that person on or after
5959 that date is creditable in the retirement system.
6060 (c) For purposes of administering the changes in law made by
6161 this Act to Subtitle B, Title 8, Government Code, the retirement
6262 system, the State Board of Education, and, if necessary as
6363 determined by the retirement system, the Texas Education Agency,
6464 shall enter into a memorandum of understanding on the collection of
6565 member contributions and other matters the retirement system
6666 considers advisable.
6767 (d) The retirement system may adopt rules to implement
6868 Subtitle B, Title 8, Government Code, as amended by this Act.
6969 SECTION 6. This Act takes effect September 1, 2025.
