88 AN ACT
99 relating to first responder broadband network services used by
1010 first responders.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 411, Government Code, is amended by
1313 adding Subchapter N-1 to read as follows:
1414 SUBCHAPTER N-1. FIRST RESPONDER BROADBAND NETWORK SERVICE
1515 Sec. 411.411. DEFINITIONS. In this subchapter:
1616 (1) "First responder" has the meaning assigned by
1717 Section 161.0001, Health and Safety Code.
1818 (2) "First responder broadband network service" means
1919 a dedicated wireless broadband communications network specifically
2020 designed for use by first responders.
2121 Sec. 411.412. SELECTION OF SERVICE PROVIDER FOR DEPARTMENT
2222 FIRST RESPONDERS. (a) The department shall select and procure from
2323 a provider a first responder broadband network service for use by
2424 first responders who are department employees. The first responder
2525 broadband network service selected by the department for department
2626 employees must have service availability in all areas of the state.
2727 (b) In the event that a department employee is terminated by
2828 or otherwise separates from employment with the department, the
2929 department shall inform the first responder broadband network
3030 service provider of that fact and require the provider to cancel
3131 that employee's access to the service.
3232 Sec. 411.413. ASSISTANCE TO OTHER FIRST RESPONDERS. (a)
3333 The department may assist first responders who are not department
3434 employees to select and secure a first responder broadband network
3535 service or to renew a first responder broadband network service
3636 previously secured by the first responders.
3737 (b) For purposes of Subsection (a), the department shall
3838 maintain a database that lists the first responder broadband
3939 network service providers in this state. The database must include
4040 information that demonstrates the service area of each provider, as
4141 well as the average broadband network service availability of the
4242 system offered by the provider at each location within the
4343 provider's service area.
4444 Sec. 411.414. ANNUAL REPORT. Not later than December 1 of
4545 each year, the department shall prepare and submit to the
4646 lieutenant governor, the speaker of the house of representatives,
4747 and each other member of the legislature an annual report that
4848 includes:
4949 (1) an evaluation of the effectiveness of first
5050 responder broadband network services, the total cost of these
5151 services to the state, and the current method of paying those costs;
5252 (2) data on the outcomes, including failures and
5353 successes, of first responder broadband network services during
5454 natural disasters, mass shootings, bombings, and other
5555 circumstances that require use of the first responder broadband
5656 network services;
5757 (3) data on use of first responder broadband network
5858 services, including the name of the provider of the service and the
5959 number of first responders using the service offered by each
6060 provider; and
6161 (4) recommendations for improving emergency and first
6262 responder communication operability and interoperability and
6363 enhancing resource capabilities.
6464 SECTION 2. This Act takes effect September 1, 2025.
