11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 411, Government Code, is amended by |
---|
13 | 13 | | adding Subchapter N-1 to read as follows: |
---|
14 | 14 | | SUBCHAPTER N-1. FIRST RESPONDER BROADBAND NETWORK SERVICE |
---|
15 | 15 | | Sec. 411.411. DEFINITIONS. In this subchapter: |
---|
16 | 16 | | (1) "First responder" has the meaning assigned by |
---|
17 | 17 | | Section 161.0001, Health and Safety Code. |
---|
18 | 18 | | (2) "First responder broadband network service" means |
---|
19 | 19 | | a dedicated wireless broadband communications network specifically |
---|
20 | 20 | | designed for use by first responders. |
---|
21 | 21 | | Sec. 411.412. SELECTION OF SERVICE PROVIDER FOR DEPARTMENT |
---|
22 | 22 | | FIRST RESPONDERS. (a) The department shall select and procure from |
---|
23 | 23 | | a provider a first responder broadband network service for use by |
---|
24 | 24 | | first responders who are department employees. The first responder |
---|
25 | 25 | | broadband network service selected by the department for department |
---|
26 | 26 | | employees must have service availability in all areas of the state. |
---|
27 | 27 | | (b) In the event that a department employee is terminated by |
---|
28 | 28 | | or otherwise separates from employment with the department, the |
---|
29 | 29 | | department shall inform the first responder broadband network |
---|
30 | 30 | | service provider of that fact and require the provider to cancel |
---|
31 | 31 | | that employee's access to the service. |
---|
32 | 32 | | Sec. 411.413. ASSISTANCE TO OTHER FIRST RESPONDERS. (a) |
---|
33 | 33 | | The department may assist first responders who are not department |
---|
34 | 34 | | employees to select and secure a first responder broadband network |
---|
35 | 35 | | service or to renew a first responder broadband network service |
---|
36 | 36 | | previously secured by the first responders. |
---|
37 | 37 | | (b) For purposes of Subsection (a), the department shall |
---|
38 | 38 | | maintain a database that lists the first responder broadband |
---|
39 | 39 | | network service providers in this state. The database must include |
---|
40 | 40 | | information that demonstrates the service area of each provider, as |
---|
41 | 41 | | well as the average broadband network service availability of the |
---|
42 | 42 | | system offered by the provider at each location within the |
---|
43 | 43 | | provider's service area. |
---|
44 | 44 | | Sec. 411.414. ANNUAL REPORT. Not later than December 1 of |
---|
45 | 45 | | each year, the department shall prepare and submit to the |
---|
46 | 46 | | lieutenant governor, the speaker of the house of representatives, |
---|
47 | 47 | | and each other member of the legislature an annual report that |
---|
48 | 48 | | includes: |
---|
49 | 49 | | (1) an evaluation of the effectiveness of first |
---|
50 | 50 | | responder broadband network services, the total cost of these |
---|
51 | 51 | | services to the state, and the current method of paying those costs; |
---|
52 | 52 | | (2) data on the outcomes, including failures and |
---|
53 | 53 | | successes, of first responder broadband network services during |
---|
54 | 54 | | natural disasters, mass shootings, bombings, and other |
---|
55 | 55 | | circumstances that require use of the first responder broadband |
---|
56 | 56 | | network services; |
---|
57 | 57 | | (3) data on use of first responder broadband network |
---|
58 | 58 | | services, including the name of the provider of the service and the |
---|
59 | 59 | | number of first responders using the service offered by each |
---|
60 | 60 | | provider; and |
---|
61 | 61 | | (4) recommendations for improving emergency and first |
---|
62 | 62 | | responder communication operability and interoperability and |
---|
63 | 63 | | enhancing resource capabilities. |
---|
64 | 64 | | SECTION 2. This Act takes effect September 1, 2025. |
