| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 21.105(b), Transportation Code, is | |
| 14 | 14 | amended to read as follows: | |
| 15 | 15 | (b) Before approving a loan or grant, the commission shall | |
| 16 | 16 | require that: | |
| 17 | 17 | (1) the airport or facility remain in the control of | |
| 18 | 18 | each political subdivision involved for at least 20 years; | |
| 19 | 19 | (2) the political subdivision disclose the source of | |
| 20 | 20 | all funds for the project and the political subdivision's ability | |
| 21 | 21 | to finance and operate the project; | |
| 22 | 22 | (3) at least: | |
| 23 | 23 | (A) 10 percent of the total project cost be | |
| 24 | 24 | provided by sources other than the state; or | |
| 25 | 25 | (B) if the airport is located in an economically | |
| 26 | 26 | disadvantaged county, as defined by Section 222.053, five percent | |
| 27 | 27 | of the total project cost be provided by sources other than the | |
| 28 | 28 | state; and | |
| 29 | 29 | (4) the project be adequately planned. | |
| 30 | 30 | SECTION 2. This Act takes effect September 1, 2025. |
