| 12 | 12 | SECTION 1. Section 21.105, Transportation Code, is amended | |
| 13 | 13 | by adding Subsection (c) to read as follows: | |
| 14 | 14 | (c) Subsection (b)(3) does not apply to a project for which | |
| 15 | 15 | money is: | |
| 16 | 16 | (1) appropriated by the legislature specifically for | |
| 17 | 17 | that purpose; and | |
| 18 | 18 | (2) administered by the department on a pass-through | |
| 19 | 19 | basis. | |
| 20 | 20 | SECTION 2. Section 21.114(b), Transportation Code, is | |
| 21 | 21 | repealed. | |
| 22 | 22 | SECTION 3. This Act takes effect September 1, 2025. |
