77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the dedication and management of water rights placed in
1010 the Texas Water Trust.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 12.028(b) and (c), Parks and Wildlife
1313 Code, are amended to read as follows:
1414 (b) Consistent with Section 11.0235(b), Water Code, and the
1515 department's duties and responsibilities, the department shall
1616 encourage and facilitate the dedication of surface water rights in
1717 the Texas Water Trust through lease, donation, purchase, or other
1818 means of voluntary transfer for environmental needs, including for
1919 the purpose of maintaining or improving:
2020 (1) instream flows;
2121 (2) water quality;
2222 (3) fish and wildlife habitat; and
2323 (4) bay and estuary inflows.
2424 (c) The department may manage surface water rights in the
2525 Texas Water Trust in a manner that is consistent with:
2626 (1) the manner in which a holder of the rights may
2727 manage the rights;
2828 (2) the dedication of the rights, including the
2929 dedication's terms and conditions;
3030 (3) Sections 11.0237, 11.027, and 11.122, Water Code;
3131 and
3232 (4) maximizing environmental benefits.
3333 SECTION 2. Section 15.7031, Water Code, is amended by
3434 amending Subsections (c) and (e) and adding Subsection (c-1) to
3535 read as follows:
3636 (c) The dedication of any surface water rights placed in
3737 trust must be reviewed and approved by the commission, in
3838 consultation with the board and the Parks and Wildlife Department.
3939 In addition, the Department of Agriculture may provide input to the
4040 commission, as appropriate, during the review and approval process
4141 for the dedication of surface water rights.
4242 (c-1) The dedication of any groundwater rights placed in
4343 trust must be reviewed and approved by the board. The board must
4444 provide notice of the dedication to any district or authority that:
4545 (1) was created under Section 52, Article III, or
4646 Section 59, Article XVI, Texas Constitution; and
4747 (2) has the authority to regulate the spacing of or
4848 production from water wells located in the aquifer, subdivision of
4949 the aquifer, or geologic stratum in which the groundwater that is
5050 the subject of the groundwater rights is located.
5151 (e) The Parks and Wildlife Department may manage surface
5252 water rights in the trust:
5353 (1) under a voluntary agreement with a rights holder;
5454 and
5555 (2) in the manner described by Section 12.028(c),
5656 Parks and Wildlife Code.
5757 SECTION 3. This Act takes effect September 1, 2025.
