| 11 | 11 | | registration fees to cover the cost of removing derelict vessels |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 11.032, Parks and Wildlife Code, is |
|---|
| 15 | 15 | | amended by amending Subsection (c) and adding Subsection (d) to |
|---|
| 16 | 16 | | read as follows: |
|---|
| 17 | 17 | | (c) Not later than the 10th day of each month the department |
|---|
| 18 | 18 | | may transfer an amount not to exceed 15 percent of all amounts |
|---|
| 19 | 19 | | collected during the previous month from sources described by |
|---|
| 20 | 20 | | Subsection (b)(16) [(b)(15), (16),] or (22) to the state parks |
|---|
| 21 | 21 | | account. |
|---|
| 22 | 22 | | (d) Not later than the 10th day of each month the |
|---|
| 23 | 23 | | department: |
|---|
| 24 | 24 | | (1) may transfer an amount not to exceed 10 percent of |
|---|
| 25 | 25 | | all amounts collected during the previous month from a source |
|---|
| 26 | 26 | | described by Subsection (b)(15) to the state parks account; and |
|---|
| 27 | 27 | | (2) shall transfer an amount equal to 5 percent of all |
|---|
| 28 | 28 | | amounts collected during the previous month from a source described |
|---|
| 29 | 29 | | by Subsection (b)(15) to the derelict vessels and structures |
|---|
| 30 | 30 | | account. |

| 31 | 31 | | SECTION 2. Subchapter D, Chapter 40, Natural Resources |
|---|
| 32 | 32 | | Code, is amended by adding Section 40.163 to read as follows: |
|---|
| 33 | 33 | | Sec. 40.163. DERELICT VESSELS AND STRUCTURES ACCOUNT. (a) |
|---|
| 34 | 34 | | The derelict vessels and structures account is a separate account |
|---|
| 35 | 35 | | in the general revenue fund. |
|---|
| 36 | 36 | | (b) The account consists of: |
|---|
| 37 | 37 | | (1) transfers made to the account under Section |
|---|
| 38 | 38 | | 11.032(d)(2), Parks and Wildlife Code; and |
|---|
| 39 | 39 | | (2) money appropriated to the General Land Office for |
|---|
| 40 | 40 | | the removal and disposal of any vessel or structure described by |
|---|
| 41 | 41 | | Section 40.108(a). |
|---|
| 42 | 42 | | (c) The General Land Office may accept a gift, grant, or |
|---|
| 43 | 43 | | bequest of money, securities, services, or property to carry out |
|---|
| 44 | 44 | | any purpose related to the removal and disposal of any vessel or |
|---|
| 45 | 45 | | structure described by Section 40.108(a). All money or securities |
|---|
| 46 | 46 | | accepted under this subsection shall be deposited to the credit of |
|---|
| 47 | 47 | | the account. |
|---|
| 48 | 48 | | (d) The General Land Office may use money in the account |
|---|
| 49 | 49 | | only to support the removal and disposal of any vessel or structure |
|---|
| 50 | 50 | | described by Section 40.108(a). |
|---|
| 51 | 51 | | (e) Money in the account not used in a fiscal year remains in |
|---|
| 52 | 52 | | the account. |
|---|
| 53 | 53 | | SECTION 3. This Act takes effect September 1, 2025. |
