77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transfer by the Parks and Wildlife Department to the
1010 General Land Office of a portion of the revenue derived from vessel
1111 registration fees to cover the cost of removing derelict vessels
1212 from waterways.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 11.032, Parks and Wildlife Code, is
1515 amended by amending Subsection (c) and adding Subsection (d) to
1616 read as follows:
1717 (c) Not later than the 10th day of each month the department
1818 may transfer an amount not to exceed 15 percent of all amounts
1919 collected during the previous month from sources described by
2020 Subsection (b)(16) [(b)(15), (16),] or (22) to the state parks
2121 account.
2222 (d) Not later than the 10th day of each month the
2323 department:
2424 (1) may transfer an amount not to exceed 10 percent of
2525 all amounts collected during the previous month from a source
2626 described by Subsection (b)(15) to the state parks account; and
2727 (2) shall transfer an amount equal to 5 percent of all
2828 amounts collected during the previous month from a source described
2929 by Subsection (b)(15) to the derelict vessels and structures
3030 account.
3131 SECTION 2. Subchapter D, Chapter 40, Natural Resources
3232 Code, is amended by adding Section 40.163 to read as follows:
3333 Sec. 40.163. DERELICT VESSELS AND STRUCTURES ACCOUNT. (a)
3434 The derelict vessels and structures account is a separate account
3535 in the general revenue fund.
3636 (b) The account consists of:
3737 (1) transfers made to the account under Section
3838 11.032(d)(2), Parks and Wildlife Code; and
3939 (2) money appropriated to the General Land Office for
4040 the removal and disposal of any vessel or structure described by
4141 Section 40.108(a).
4242 (c) The General Land Office may accept a gift, grant, or
4343 bequest of money, securities, services, or property to carry out
4444 any purpose related to the removal and disposal of any vessel or
4545 structure described by Section 40.108(a). All money or securities
4646 accepted under this subsection shall be deposited to the credit of
4747 the account.
4848 (d) The General Land Office may use money in the account
4949 only to support the removal and disposal of any vessel or structure
5050 described by Section 40.108(a).
5151 (e) Money in the account not used in a fiscal year remains in
5252 the account.
5353 SECTION 3. This Act takes effect September 1, 2025.
