9 | 9 | | relating to assessment and reporting requirements regarding safety |
---|
10 | 10 | | and security in public schools. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 37.1083, Education Code, is amended by |
---|
13 | 13 | | amending Subsections (c), (g), and (h) and adding Subsection (h-1) |
---|
14 | 14 | | to read as follows: |
---|
15 | 15 | | (c) The agency shall, in coordination with the Texas School |
---|
16 | 16 | | Safety Center and relevant local law enforcement agencies, provide |
---|
17 | 17 | | technical assistance to school districts to support the |
---|
18 | 18 | | implementation and operation of safety and security requirements, |
---|
19 | 19 | | including providing resources that a school district may use for |
---|
20 | 20 | | reporting requirements imposed under this section. |
---|
21 | 21 | | (g) The agency may engage a third party as necessary to |
---|
22 | 22 | | enable the agency to monitor the implementation and operation of |
---|
23 | 23 | | school district safety and security requirements under this |
---|
24 | 24 | | section, including providing resources that a school district may |
---|
25 | 25 | | use for reporting requirements imposed under this section. |
---|
26 | 26 | | (h) The agency may require a school district to submit |
---|
27 | 27 | | information necessary for the agency to monitor the implementation |
---|
28 | 28 | | and operation of school district safety and security requirements |
---|
29 | 29 | | under this section, including: |
---|
30 | 30 | | (1) notice of an event requiring a district's |
---|
31 | 31 | | emergency response including the discovery of a firearm on a |
---|
32 | 32 | | campus; [and] |
---|
33 | 33 | | (2) information regarding the district's response and |
---|
34 | 34 | | use of emergency operations procedures during an event described by |
---|
35 | 35 | | Subdivision (1); and |
---|
36 | 36 | | (3) information related to: |
---|
37 | 37 | | (A) threat assessments conducted under Section |
---|
38 | 38 | | 37.115; |
---|
39 | 39 | | (B) emergency management; |
---|
40 | 40 | | (C) vulnerability assessments conducted under |
---|
41 | 41 | | this section; and |
---|
42 | 42 | | (D) intruder detection audits conducted under |
---|
43 | 43 | | Section 37.1084. |
---|
44 | 44 | | (h-1) Notwithstanding any other provision of this section, |
---|
45 | 45 | | the agency may not prescribe the manner in which a school district |
---|
46 | 46 | | submits information to the agency under this section. |
---|
47 | 47 | | SECTION 2. Section 37.115, Education Code, is amended by |
---|
48 | 48 | | adding Subsection (k-1) to read as follows: |
---|
49 | 49 | | (k-1) Notwithstanding any other provision of this section, |
---|
50 | 50 | | the agency may not prescribe the threat assessment materials or |
---|
51 | 51 | | instrument used under this section or the manner in which a team |
---|
52 | 52 | | must conduct a threat assessment under this section. |
---|
53 | 53 | | SECTION 3. This Act applies beginning with the 2025-2026 |
---|
54 | 54 | | school year. |
---|
55 | 55 | | SECTION 4. This Act takes effect immediately if it receives |
---|
56 | 56 | | a vote of two-thirds of all the members elected to each house, as |
---|
57 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
58 | 58 | | Act does not receive the vote necessary for immediate effect, this |
---|
59 | 59 | | Act takes effect September 1, 2025. |
