77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to assessment and reporting requirements regarding safety
1010 and security in public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 37.1083, Education Code, is amended by
1313 amending Subsections (c), (g), and (h) and adding Subsection (h-1)
1414 to read as follows:
1515 (c) The agency shall, in coordination with the Texas School
1616 Safety Center and relevant local law enforcement agencies, provide
1717 technical assistance to school districts to support the
1818 implementation and operation of safety and security requirements,
1919 including providing resources that a school district may use for
2020 reporting requirements imposed under this section.
2121 (g) The agency may engage a third party as necessary to
2222 enable the agency to monitor the implementation and operation of
2323 school district safety and security requirements under this
2424 section, including providing resources that a school district may
2525 use for reporting requirements imposed under this section.
2626 (h) The agency may require a school district to submit
2727 information necessary for the agency to monitor the implementation
2828 and operation of school district safety and security requirements
2929 under this section, including:
3030 (1) notice of an event requiring a district's
3131 emergency response including the discovery of a firearm on a
3232 campus; [and]
3333 (2) information regarding the district's response and
3434 use of emergency operations procedures during an event described by
3535 Subdivision (1); and
3636 (3) information related to:
3737 (A) threat assessments conducted under Section
3838 37.115;
3939 (B) emergency management;
4040 (C) vulnerability assessments conducted under
4141 this section; and
4242 (D) intruder detection audits conducted under
4343 Section 37.1084.
4444 (h-1) Notwithstanding any other provision of this section,
4545 the agency may not prescribe the manner in which a school district
4646 submits information to the agency under this section.
4747 SECTION 2. Section 37.115, Education Code, is amended by
4848 adding Subsection (k-1) to read as follows:
4949 (k-1) Notwithstanding any other provision of this section,
5050 the agency may not prescribe the threat assessment materials or
5151 instrument used under this section or the manner in which a team
5252 must conduct a threat assessment under this section.
5353 SECTION 3. This Act applies beginning with the 2025-2026
5454 school year.
5555 SECTION 4. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2025.
