77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to permissible uses of the school safety allotment under
1010 the Foundation School Program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 48.115(b), Education Code, is amended to
1313 read as follows:
1414 (b) Funds allocated under this section must be used to
1515 improve school safety and security, including costs associated
1616 with:
1717 (1) securing school facilities in accordance with the
1818 requirements of Section 37.351, including:
1919 (A) improvements to school infrastructure;
2020 (B) the use or installation of perimeter security
2121 fencing conducive to a public school learning environment or
2222 physical barriers, which may not include razor wire;
2323 (C) exterior door and window safety and security
2424 upgrades, including exterior door numbering and locking systems and
2525 security film that provides resistance to a forced entry; and
2626 (D) the purchase and maintenance of:
2727 (i) security cameras and, if the district
2828 has already installed security cameras, other security equipment,
2929 including video surveillance as provided by Section 29.022; [and]
3030 (ii) technology, including communications
3131 systems or devices, such as silent panic alert devices, two-way
3232 radios, or wireless Internet booster equipment, that facilitates
3333 communication and information sharing between students, school
3434 personnel, and first responders in an emergency; and
3535 (iii) mobile metal detectors;
3636 (2) providing security for the district, including:
3737 (A) employing school district peace officers,
3838 private security officers, and school marshals; and
3939 (B) collaborating with local law enforcement
4040 agencies, such as entering into a memorandum of understanding for
4141 the assignment of school resource officers to schools in the
4242 district;
4343 (3) school safety and security measures, including:
4444 (A) active shooter and emergency response
4545 training;
4646 (B) prevention and treatment programs relating
4747 to addressing adverse childhood experiences; and
4848 (C) the prevention, identification, and
4949 management of emergencies and threats, using evidence-based,
5050 effective prevention practices and including:
5151 (i) providing licensed counselors, social
5252 workers, chaplains, and individuals trained in restorative
5353 discipline and restorative justice practices;
5454 (ii) providing mental health personnel and
5555 support, including chaplains;
5656 (iii) providing behavioral health
5757 services, including services provided by chaplains;
5858 (iv) establishing threat reporting
5959 systems; and
6060 (v) developing and implementing programs
6161 focused on restorative justice practices, culturally relevant
6262 instruction, and providing mental health support, including
6363 support provided by chaplains;
6464 (4) providing programs related to suicide prevention,
6565 intervention, and postvention, including programs provided by
6666 chaplains; and
6767 (5) employing a school safety director and other
6868 personnel to manage and monitor school safety initiatives and the
6969 implementation of school safety requirements for the district.
7070 SECTION 2. This Act takes effect September 1, 2025.
