77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to automobile insurance rating plan consequences for
1010 traffic violation charges or convictions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1953.051(a), Insurance Code, is amended
1313 to read as follows:
1414 (a) A rating plan regarding the writing of automobile
1515 insurance [, other than insurance written under Chapter 2151,] may
1616 [not]:
1717 (1) assign a rate consequence to a charge or
1818 conviction for a violation of Subtitle C, Title 7, Transportation
1919 Code; or
2020 (2) otherwise cause premiums for automobile insurance
2121 to be increased because of a charge or conviction described by
2222 Subdivision (1).
2323 SECTION 2. Section 1953.051, Insurance Code, as amended by
2424 this Act, applies only to an insurance policy delivered, issued for
2525 delivery, or renewed on or after January 1, 2026. A policy
2626 delivered, issued for delivery, or renewed before January 1, 2026,
2727 is governed by the law as it existed immediately before the
2828 effective date of this Act, and that law is continued in effect for
2929 that purpose.
3030 SECTION 3. This Act takes effect September 1, 2025.
