9 | 9 | relating to automobile insurance rating plan consequences for | |
10 | 10 | traffic violation charges or convictions. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 1953.051(a), Insurance Code, is amended | |
13 | 13 | to read as follows: | |
14 | 14 | (a) A rating plan regarding the writing of automobile | |
15 | 15 | insurance [, other than insurance written under Chapter 2151,] may | |
16 | 16 | [not]: | |
17 | 17 | (1) assign a rate consequence to a charge or | |
18 | 18 | conviction for a violation of Subtitle C, Title 7, Transportation | |
19 | 19 | Code; or | |
20 | 20 | (2) otherwise cause premiums for automobile insurance | |
21 | 21 | to be increased because of a charge or conviction described by | |
22 | 22 | Subdivision (1). | |
23 | 23 | SECTION 2. Section 1953.051, Insurance Code, as amended by | |
24 | 24 | this Act, applies only to an insurance policy delivered, issued for | |
25 | 25 | delivery, or renewed on or after January 1, 2026. A policy | |
26 | 26 | delivered, issued for delivery, or renewed before January 1, 2026, | |
27 | 27 | is governed by the law as it existed immediately before the | |
28 | 28 | effective date of this Act, and that law is continued in effect for | |
29 | 29 | that purpose. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2025. |
