77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to access to certain law enforcement, corrections,
1010 prosecutorial, and civil enforcement records under the public
1111 information law.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Section 552.108, Government Code,
1414 is amended to read as follows:
1515 Sec. 552.108. EXCEPTION: CERTAIN LAW ENFORCEMENT,
1616 CORRECTIONS, [AND] PROSECUTORIAL, AND CIVIL ENFORCEMENT
1717 INFORMATION.
1818 SECTION 2. Section 552.108(a), Government Code, is amended
1919 to read as follows:
2020 (a) Information held by a law enforcement agency, a [or]
2121 prosecutor, or the attorney general that deals with the detection,
2222 investigation, or prosecution of crime or other violation of law is
2323 excepted from the requirements of Section 552.021 if:
2424 (1) release of the information would interfere with
2525 the detection, investigation, or prosecution of crime or other
2626 violation of law;
2727 (2) it is information that deals with the detection,
2828 investigation, or prosecution of crime only in relation to an
2929 investigation that did not result in conviction or deferred
3030 adjudication;
3131 (3) it is information relating to a threat against a
3232 peace officer or detention officer collected or disseminated under
3333 Section 411.048; or
3434 (4) it is information that:
3535 (A) is prepared by an attorney representing the
3636 state in anticipation of or in the course of preparing for criminal
3737 litigation or civil enforcement litigation; or
3838 (B) reflects the mental impressions or legal
3939 reasoning of an attorney representing the state.
4040 SECTION 3. The changes in law made by this Act apply only to
4141 a request for information that is received by a governmental body or
4242 an officer or employee of a governmental body on or after the
4343 effective date of this Act.
4444 SECTION 4. This Act takes effect September 1, 2025.
