10 | 10 | | prosecutorial, and civil enforcement records under the public |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. The heading to Section 552.108, Government Code, |
---|
14 | 14 | | is amended to read as follows: |
---|
15 | 15 | | Sec. 552.108. EXCEPTION: CERTAIN LAW ENFORCEMENT, |
---|
16 | 16 | | CORRECTIONS, [AND] PROSECUTORIAL, AND CIVIL ENFORCEMENT |
---|
17 | 17 | | INFORMATION. |
---|
18 | 18 | | SECTION 2. Section 552.108(a), Government Code, is amended |
---|
19 | 19 | | to read as follows: |
---|
20 | 20 | | (a) Information held by a law enforcement agency, a [or] |
---|
21 | 21 | | prosecutor, or the attorney general that deals with the detection, |
---|
22 | 22 | | investigation, or prosecution of crime or other violation of law is |
---|
23 | 23 | | excepted from the requirements of Section 552.021 if: |
---|
24 | 24 | | (1) release of the information would interfere with |
---|
25 | 25 | | the detection, investigation, or prosecution of crime or other |
---|
26 | 26 | | violation of law; |
---|
27 | 27 | | (2) it is information that deals with the detection, |
---|
28 | 28 | | investigation, or prosecution of crime only in relation to an |
---|
29 | 29 | | investigation that did not result in conviction or deferred |
---|
30 | 30 | | adjudication; |
---|
31 | 31 | | (3) it is information relating to a threat against a |
---|
32 | 32 | | peace officer or detention officer collected or disseminated under |
---|
33 | 33 | | Section 411.048; or |
---|
34 | 34 | | (4) it is information that: |
---|
35 | 35 | | (A) is prepared by an attorney representing the |
---|
36 | 36 | | state in anticipation of or in the course of preparing for criminal |
---|
37 | 37 | | litigation or civil enforcement litigation; or |
---|
38 | 38 | | (B) reflects the mental impressions or legal |
---|
39 | 39 | | reasoning of an attorney representing the state. |
---|
40 | 40 | | SECTION 3. The changes in law made by this Act apply only to |
---|
41 | 41 | | a request for information that is received by a governmental body or |
---|
42 | 42 | | an officer or employee of a governmental body on or after the |
---|
43 | 43 | | effective date of this Act. |
---|
44 | 44 | | SECTION 4. This Act takes effect September 1, 2025. |
